RULES & REGULATIONS FOR SUBMISSION

Note: Those who are willing and able to physically attend the festival get first preference.

The following is an explanation of the rules and regulations (“Rules & Regulations”) governing the submission of a film, trailer, feature, short, music video, web series, reality show pilot, demo reel, short animation, sizzle reel, documentary, short screenplay (hereafter called the “Project”) to the Widescreen Film & Music Video Festival, a Limited Liability Company (hereinafter called the “Company”) for consideration of the 2019 Widescreen Film & Music Video Festival (hereinafter called the “Festival”). All information contained in this document shall herein supersede any prior information regarding submission to the Festival.

By agreeing to the Terms and Conditions found on the Festival submission form located at www.widescreenfest.com/terms-and-conditions/, the person submitting the Project (hereafter called the “Applicant”) acknowledges that he or she has obtained consent from any and all owners, creators, writers, Producers and/or other authorized representatives of the Project (hereafter called the “Project’s Owners”) whose consent is required to submit the Project to the Company, and has read and understood the submission rules and regulations set forth below:

I. GENERAL RULES

The submission categories and program categories that are referenced and identified as capitalized terms in the Section I of the Rules and Regulations, and the eligibility requirements for each, shall be understood as having the definitions and descriptions assigned to them in Sections II and III of these Rules and Regulations below.

1. There is NO limit to the number of submissions per Project Owner. However, each submission requires the fee detailed in Paragraph 2(g), Table 1.1, Section I, of these Rules and Regulations.
2. Submission Fees.
a. All submission fees are non-refundable.
b. All submission fees must be in U.S. currency and are based on U.S. currency value.
c. NOTE: There will be many submissions, but only those selected will be shown. The submitter accepts that by submitting and paying the submission fee their submission might not be selected.
d. Works submitted that do not meet criteria or fail to adhere to the guidelines, rules and regulations is not the responsibility of the Company or Festival. These submissions may be automatic disqualification and loss of submission fee.
e. Submission fees are based on date submitted as outline in 2(g) below and not based on length or running time of project.
f. Submission fee is not based on length

3. Submissions begin being accepted on once Call for Entries open.

4. Submissions accepted are listed under Section II of these Rules & Regulations. Applicant assumes sole responsibility of determining whether Festival and Company will accept the Project from Applicant. Company retains sole and exclusive right to disqualify any submission by Applicant that does not meet one the categories in Section II. Applicant understands, that disqualification results in loss of the submission fee.

5. Any submissions must be properly categorized and must meet the parameters outlined for the categories outlined in Section II of these Rules & Regulations.

6. We will not accept any Project that already has distribution rights with a company unless you can prove you still own the Project rights or that the distributor is granting you permission to enter the festival due to legal and copyright issues.

7. Company reserves the sole and exclusive right to determine if previously released, previously distributed or previous or current distributed Project will be eligible for the Festival. Applicant is solely and exclusively responsible for any works submitted that are in violation of copyright.
8. Company and Festival assume no responsibility for submissions. Applicant will indemnify and hold harmless Company and Festival should any submission violate any laws of any country or the United States to include those regarding property rights such as copyrights, distribution rights violations, false statements submitted on applications, and any other illegality propounded on the Festival and Company as a result of the submitter. See Paragraph 10 below as also an extension of this Paragraph.

9. Projects that have been previously submitted to the Festival or to other festivals in previous years are eligible for re-submission to this Festival for consideration. However, re-submission does not guarantee the Project will be chosen this time around nor can Festival or Company guarantee that the work will be shown at the Festival.

10. Company reserves the sole and exclusive right to choose which works will be shown, without refund of any or all submission fees previously collected.

11. It is the sole responsibility of the Applicant to secure authorization and permission from copyright owner(s) of any and all copyrighted content or materials included within the submitted Project. The Company and Festival expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any copyrighted content or materials within or relating to submitted Project, including any content materials that are or may become the basis for any third party claims for copyright infringement. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project with any unauthorized inclusion of copyrighted content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity that alleges the Project makes unauthorized or unlawful use of any copyrighted content or material, Applicant shall fully indemnify and hold harmless the Company, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection therewith. The statements in this Paragraph regarding liability and costs also are in full force and effect for Paragraph 7 above.

12. It is the sole responsibility of the Applicant to secure authorization and permission from the Project’s Owners of any and all trademarked content or materials included within the submitted Project. The Company expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any trademarked content or materials within or relating to submitted Project, including any content materials that are or may become the basis for any third party claims for trademark infringement, trademark dilution or unfair competition. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project with any unauthorized inclusion of trademarked content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity that alleges the Project makes unauthorized or unlawful use of any trademarked content or material, Applicant shall fully indemnify and hold harmless the Company, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection therewith.

13. It is the sole responsibility of the Applicant to clear all content of the Project from any and all actual or potential legal claims or issues, including, without limitation, claims based upon theories or libel, defamation, slander, invasion of privacy, violation of rights or publicity, theft or trade secrets, breach of confidence, breach of confidential relationship, and breach of expressed or implied contract (“Third Party Claim(s)”). The Company expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any trademarked content or materials within or relating to submitted Project, including any content materials that are or may become the basis for any Third Party Claims based upon any of the foregoing legal theories or others. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project that is or may become the subject of any Third Party Claims. In the event that any Third Party Claim(s) shall be asserted by any person or entity, Applicant shall fully indemnify and hold harmless the Company, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection therewith.

14. Applicants submitting Projects that contain significant non-English spoken dialogue must provide on-screen English subtitles. Music videos do not have to meet this criteria but all other works must meet this criteria. Documentaries that have English voice translation within do not have to contain this English sub-titling as well so long as some type of translation is provided by voice. The Company reserves the right to disqualify, without refund or any or all submission fees previously collected from the Applicant, any Project that contains significant non-English spoken dialogue that does not include accompanying on-screen English subtitles.

15. Submission of Project:

a. Where:
All Projects must be initially submitted via URL Link using such platforms as YouTube and Vimeo. Additionally, the video file may also be directly uploaded securely to FilmFreeway, located at: https://filmfreeway.com/festival/widescreenfestival

16. It is the sole responsibility of the Applicant to ensure that any submitted Project via internet video link is correct and functions. In the event that an internet video submission is not able to be viewed or fails to play, the Company will attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to obtain a replacement link of the Project. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project for which such aforementioned or similar issues should arise.

17. If Project is Selected: It is the sole responsibility of the Applicant to ensure that any submitted Secure Online Screener, Youtube Link, Vimeo Private Link, Or QuickTime H.264 Video File Contained on a Hard Drive or similar Media plays in its entirety and that such a Hard Drive or Other Media is properly formatted to work with both a PC and MAC, prior to submitting it to the Festival. In the event that a Secure Online Screener, Vimeo Private Link, or QuickTime H.264 Video File does not play or cannot be accessed, the Company will attempt, but is under no obligation, to contact the Applicant using the contact information provided on the Submission Form in an effort to obtain a replacement copy of the Project. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project for which the initially-submitted Project does not play or cannot be accessed. It is the sole responsibility of costs for any mailings of any DVDs, hard drives, or other forms of submission both in digital or physical format. Company and Festival assume no costs or obligations. In the event, Applicant is unable to submit a working Project, the Project and Applicant are disqualified and surrender any submission fees. Applicant holds harmless Festival and Company in any such occurrence of events.

18. It is the sole responsibility of the Applicant to ensure that the submitted Project link is provided to the Company by the Applicant upon completion of the submission form. In the event that a submitted Project link does not play or function, within the deadline window selected by the Applicant, the Company will attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to obtain a proper functioning submission copy of the Project. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project that does not play or function within the deadline window selected by the Applicant.

19. In the event that the Applicant remits an updated version of the Project to the Company after having submitted a previous version of the Project to the Company during the same calendar year, the Company is under no obligation to view any or all of the updated version.

20. In order to be considered for the Festival, the Applicant must submit via FilmFreeway located at http://widescreenfest.com/submit-your-video/ as well as on the Festival’s Home page (click the Red Submit button, which redirects you to the FilmFreeway page). Additionally, the Applicant may submit directly to the FilmFreeway page, located at: https://filmfreeway.com/festival/widescreenfestival. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project that is not submitted through this platform.

21. Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project with a submission form that is considered to be delinquent due to the non-payment of any or all submission fees. The Company may attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to bring the payment status of the account up-to-date. The Company disavows any responsibility for, and will not be held responsible for, any failure to contact the Applicant and inform the Applicant of any payment delinquency or other deficiency of a submission form.

22. The Company reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Project received before June 1, 2015 or after January 31, 2016.

23. Upon completion of the Festival selection process, the Company will attempt to contact the Applicant using the contact information provided on the submission form to notify the Applicant of the Project’s acceptance status. The Company disavows any responsibility for, and will not be held responsible for, any failure to contact the Applicant using the contact information provided on the submission form. It is the sole responsibility of the Applicant to ensure that the contact information provided on the submission form is correct throughout the entirety of the Festival selection period.

24. The Company is under no obligation to provide to the Applicant or any other representative of the Project any comments or feedback regarding the submitted Project, any information relating to the manner in which the Project is, will be, or was reviewed; any views that the Company or any reviewers of the Project may hold concerning the Project; any reasons why the Project, should it not be accepted for exhibition at the Festival, was not accepted; or any other information relating to the Festival’s review, consideration and/or selection process regarding the Project specifically or submissions generally beyond the information set forth in these Rules and Regulations. The Company disavows any responsibility for, and will not be held responsible or liable for, the contents of any internal comments or feedback regarding any Project that are or may be obtained by the Applicant or any other representative of the Project; any communications by any representative of the Company or the Festival relating to the Project or the Festival’s selection process; the manner in which the Project shall be, is, or was considered and reviewed; the identity or identities of any specific reviewers of the Project; and/or any failure on the part of the Company or the Festival to provide the Applicant or any other representative(s) of the Project with information concerning the Company’s consideration and/or review of the Project.

25. Festival participation and presence is Not required to submit the Project by Applicant but is strongly encouraged to further your pursuance of any possibility of interviews, publicity, exposure, networking, and possible distribution offers.

26. Company and Festival expressly deny and are not responsible for any promises of offers for distribution. This is merely an avenue or channel for Applicant to submit Project for exposure and viewing pleasure of audiences.

27. Passes, Tickets for Applicants: Applicants whose project is deemed Official Selection may receive One (1) free All-Access Pass to all of the 2016 Festival’s events.
28. Festival, Company and its affiliates reserve the sole and exclusive right to change the dates and times of viewing of Officially Selected Projects or dates of Festival. Applicant acknowledges and accepts Company, Festival and its affiliates have no control over natural disasters, acts of nature, and circumstances of emergency that might cause change in dates and times. Good faith efforts will be given by Company, Festival and its affiliates to inform Applicant of any date or time changes in advance, if possible.

II. SUBMISSION CATEGORIES & ELIGIBILITY REQUIREMENTS

Projects submitted to the Company for consideration for the Festival may apply in one of eleven submission categories. The Company reserves the right to determine eligibility of any Project for any Festival program or submission category. Company reserves the right to re-classify the Project and its category or disqualify for improper category selection. The following is a description of each submission category, along with eligibility requirements for each:

NOTE: Submission content: All of the above types of content will be considered for screening. We will consider content of all types so long as the content is not purely pornographic in nature. Nudity, violence, vulgar language and the sorts will be screened to determine if artistic and within the scope of the Festival, at the Festival’s sole discretion. We encourage all types of art and do not wish to discourage any Project, within reason.
