Outcomes of the 54th Session of the UN Human Rights Council

During the 54th session of the UN Human Rights Council, the United States worked to uphold the universal values, aspirations, and principles that have underpinned the UN system for decades. The end of this year also marks the 75th anniversary of the Universal Declaration of Human Rights and the 30th anniversary of the Vienna Declaration. These two documents are cornerstones of our system of internationally recognized human rights and fundamental freedoms.

During this session of the Council, the United States collaborated with UN Member States to highlight and address pressing human rights concerns. Our statements and positions underscored the U.S. commitment to promoting the universality of human rights, including by addressing discrimination, inequity, and inequality in all forms.

The United States also strongly supported Israel on the Council floor following the Hamas terrorist attack beginning October 7.

This session, the United States advanced priorities on issues related to the full range of human rights and fundamental freedoms, including economic, social, and cultural rights:

Establishing an investigative mandate in Sudan:

The United States was a member of the core group that established an international fact-finding mission to investigate human rights violations and abuses in Sudan. This historic action by the Council is especially important as reports of atrocities and other abuses continue, such as conflict-related sexual violence, ethnically motivated killings, and burning of villages in Darfur and elsewhere.

The GPW Team Harnessing the power of emerging technologies also requires careful risk assessment. As discourse around — and use of — generative AI increases across the private and public sectors, leaders must consider both the risks and rewards of leveraging the technology. Generative AI can provide efficiency and cost savings that meet the mission, but it also opens an organization up to a new set of challenges. Government and military leaders looking to the future will have to mitigate these risks to reap the rewards of generative AI.

Half a million people live on a sprawling volcano in Italy – and the risk of an eruption has never been greater, according to a study.

The Campi Flegrei (Phlegraean Fields) volcano may be less well-known than Vesuvius, but is “extremely dangerous”, study co-author Stefano Carlino told AFP.

Vesuvius wiped Pompeii off the map almost two millennia ago, while the vast volcanic Campi Flegrei area near Naples last spewed lava, ashes and rocks in 1538. But the Campi Flegrei is not one to take lightly – the volcano’s eruption 30,000 years ago is reported to have contributed to the extinction of Neanderthal man.Five hundred thousand people live in what Italy’s civil protection agency has designated the red zone – the area at highest risk. Another 800,000 people live in the yellow zone.

SINGAPORE – INTERPOL’s Heads of NCB conference has concluded with calls for greater innovation and information exchange to counter the security challenges posed by evolving criminal threats and technological change.

The annual meeting was one of three events held by INTERPOL over one week in Singapore (5-9 June), with the 2nd Conference of NCB Data Protection Officers and the Police Science Congress also bringing together police leaders from around the world.

The pressing need for police to innovate, leveraging artificial intelligence (AI) and other emerging technologies in a responsible and ethical manner to face a range of crime threats, was a common theme of all three gatherings.

“NCBs are at the very core of INTERPOL’s vision and our strategy. How can we strengthen NCBs to meet the operational challenges of countering criminal groups that generate corruption, wealth and power like never before?”

The following three days saw an international array of law enforcement speakers sharing experiences from their home countries while INTERPOL officers presented capabilities to support national authorities in areas from counterterrorism to online child sexual exploitation.

In the morning of Day 2, delegates broke into regional groups for a series of roundtable discussions on specific crime issues, policing tools and INTERPOL-coordinated operations.

At the conference’s close, delegates approved four conclusions – strengthening the NCB network, delivering innovation on biometric data, countering persistent forms of counterterrorism and addressing the rapidly escalating crime trend of human trafficking-fueled cyber fraud.

Biometric Hub
Throughout the Police Science Congress, speakers and delegates maintained that technology must be harnessed responsibly, respecting human rights and ethics principles.

The Congress saw INTERPOL unveil its AI Toolkit, which provides a roadmap to guide law enforcement as they move to integrate AI technology into their work.

Jointly developed with the United Nations Interregional Crime and Justice Research Institute (UNICRI), the Toolkit will help law enforcement navigate the debates and discussions that form an integral part of this process.

INTERPOL also presented a new system that draws on the latest biometric matching technology and centralizes INTERPOL’s biometric databases. Launched within INTERPOL’s I-CORE programme, the Biometric Hub provides law enforcement officers with a single access point for checking identification information against INTERPOL’s global databases.

Increasing diversity was another key objective identified by participants as critical to ensuring policing organizations continue to innovate in service of their communities. Marking INTERPOL’s 100th anniversary, the Organization released a compendium reflecting on global efforts towards greater gender inclusivity.

“No one can be certain of the security challenges the next century holds, but what the global policing community can do is position ourselves to best respond to the unknown,” said Mr Kavanagh. “And we can do this through continuing to innovate, by building a more diverse workforce, and further strengthening the backbone of international police cooperation: our global NCB network.”

Civil society calls on the EU to draw limits on surveillance technology in the Artificial Intelligence Act.

As AI systems are increasingly used by law enforcement, migration control and national security authorities, the EU Artificial Intelligence Act (AI Act) is an urgent opportunity to prevent harm, protect people from rights violations and provide legal boundaries for authorities to use AI within the confines of the rule of law.

Increasingly, in Europe and around the world, AI systems are developed and deployed for harmful and discriminatory forms of state surveillance. From the use of biometrics for identification, recognition and categorisation, to predictive systems in various decision-making and resource allocation capacities, AI in law enforcement disproportionately targets already marginalised communities, undermines legal and procedural rights, and enables mass surveillance.

When AI systems are deployed in contexts of law enforcement, security and migration control (including the policing of social security), the power imbalance between the authorities and the surveilled is even more profound. This means that there is an even greater risk of harm, and violations of fundamental rights and the rule of law.

This statement outlines the urgent need to regulate the use of AI systems by law enforcement, migration control and national security authorities throughout Europe.

We point to the specific dangers to freedom of assembly, liberty, the right to asylum, privacy and data protection, the right to social protection, and non-discrimination when such technology is deployed by those authorities.

Civil society organisations are calling for an AI Act that prevents unchecked forms of discriminatory and mass surveillance. In order to uphold human rights and prevent harm from the use of AI in policing, migration control and national security, the EU AI Act must:

Include legal limits prohibiting AI for uses that pose an unacceptable risk for fundamental rights. This includes a legal prohibition on different forms of biometric surveillance, predictive policing, and harmful uses of AI in the migration context.
Provide public transparency and oversight when police, migration and national security agencies use ‘high-risk’ AI, by upholding an equal duty of these authorities to register high risk uses in the EU AI database.
Ensure that the AI Act properly regulates the uses of AI in policing, migration and national security that pose risk to human rights, specifically the full list of AI in migration control, and ensuring that national security is not excluded from scope.
Why the EU AI Act needs to regulate the use of AI in law enforcement, migration and national security:

Checks on state and police power are essential to the functioning of a democratic rights-based society. The AI Act is intended to recognise and regulate high-risk uses of AI and, where necessary, prohibit them where the threat to fundamental rights is too great. Uses of AI by state authorities in fields of policing, migration and national security are amongst the most high risk use cases, because they most acutely impact fundamental rights including freedom of assembly and expression, the right to a fair trial, the presumption of innocence, non-discrimination, and the right to claim asylum. The work of police, migration and security authorities governs access to the public space, outcomes in the criminal justice and migration sectors, and various other areas of life with the highest impact on fundamental rights. As such, the use of AI by these authorities calls for the greatest scrutiny and transparency, and requires the clearest boundaries to uphold basic democratic principles.
The use of AI in the fields of policing, security and migration amplifies structural discrimination against already marginalised and over-surveilled communities, such as racialised people, migrants, and many other discriminated groups. Mounting evidence demonstrates that such AI systems reinforce the over-policing, disproportionate surveillance, detention and imprisonment of structurally discriminated against groups. The data used to create and operate such systems reflects historical, systemic, institutional and societal discrimination. This discrimination is so fundamental and ingrained that all such systems will reinforce such outcomes. Prohibitions, public transparency and accountability frameworks are necessary so that harms are prevented and people are empowered to challenge harms.
The use of AI in field of policing, security and migration invites private sector influence into core aspects of public governance, requiring even stronger oversight and legal limits in order to ensure peoples’ rights are upheld. As these fields are government functions, it is crucial the AI Act ensures that private sector’s development of AI in these fields is publicly transparent. AI systems, when deployed in areas of policing, migration and national security must be accountable first and foremost to fundamental rights standards and the rule of law, rather than profit motives. As such safeguards, oversight and legal limits must be applied.
