FILM SUBMISSION TERMS & CONDITIONS
LOMO – London Motorcycle Film and Photography Festival (“LOMO”)
By submitting a film to LOMO, the submitting filmmaker or rights holder (“Submitter”) agrees to the following terms:
1. Rights Grant
The Submitter grants LOMO a worldwide, perpetual, irrevocable, royalty-free, and licence to use, reproduce, screen, exhibit, distribute, publish, communicate to the public, and otherwise exploit the submitted film, in whole or in part, for purposes connected with:
the LOMO festival (including future editions)
affiliated or partner events
promotion, marketing, advertising, press, and publicity
documentation, archiving, and historical record
This licence applies across all media and platforms, whether now known or later developed, without restriction as to time, territory, or format.
No further permission or approval shall be required from the Submitter.
2. Promotional Use
LOMO may use excerpts, clips, stills, titles, trailers, and other audiovisual or graphic material derived from the film for promotional and related purposes connected to the festival.
No fees, royalties, or compensation shall be payable in connection with any such use.
3. Moral Rights
To the fullest extent permitted by applicable law, the Submitter waives all moral rights in the submitted film in favour of LOMO, including any right to object to editing, adaptation, or contextual use.
Where moral rights cannot be waived, the Submitter agrees not to assert them against LOMO and acknowledges that attribution will be provided where reasonably practicable.
4. Authority and Warranties
The Submitter warrants that:
they are the sole rights holder or are fully authorised to submit the film
all necessary consents, licences, and releases (including from performers and contributors) have been obtained
the submission and use of the film will not infringe any third-party rights
5. Data Protection (GDPR)
The Submitter consents to LOMO processing personal data contained in the film and provided during submission for purposes connected with the festival, including promotion and archiving, in accordance with applicable data protection laws and LOMO’s privacy policy.
6. Release and Indemnity
The Submitter confirms that he/she/them has/have full authority to grant these rights and releases LOMO from any claims arising from the permitted use of the submitted film and agrees to indemnify LOMO against any losses resulting from a breach of these terms.
7. Governing Law and Jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales, sitting in London, shall have exclusive jurisdiction to settle any such dispute or claim, and the parties irrevocably submit to the jurisdiction of the courts.
8. Severability
If any provision of these terms is held by any court or competent authority to be invalid, illegal, or unenforceable (in whole or in part), such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.
If such modification is not possible, the relevant provision shall be deemed deleted.
Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions of these terms, which shall continue in full force and effect.
9. Entire Agreement
These terms constitute the entire agreement between the Submitter and LOMO in relation to the submission and use of the submitted film and supersede all prior or contemporaneous agreements, understandings, representations, or communications, whether written or oral, relating to the same subject matter.
The Submitter acknowledges that they have not relied on any statement, representation, assurance, or warranty not expressly set out in these terms.
10. Waiver
No failure or delay by LOMO to exercise any right, remedy, or power under these terms shall operate as a waiver of that or any other right, remedy, or power.
No single or partial exercise of any right, remedy, or power shall prevent any further exercise of that or any other right, remedy, or power.
11. Assignment
LOMO may assign, transfer, novate, or otherwise dispose of its rights and obligations under these terms to any third party, including in connection with the organisation, promotion, or continuation of the festival.
The Submitter may not assign, transfer, or otherwise dispose of their rights or obligations under these terms without LOMO’s prior written consent.
12. Third Party Rights
A person who is not a party to these terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these terms.
13. Electronic Acceptance
The Submitter acknowledges and agrees that acceptance of these terms by electronic means (including by ticking a checkbox, clicking an “I agree” button, or submitting a film via an online platform) shall constitute a valid and binding agreement, equivalent to a handwritten signature.
