The Queer Popcorn festival is composed by two sections: the international short film competition, and a selection of films and documentaries newly awarded in international festivals. The festival’s philosophy is to present films treating socially or politically committed subjects but also humorous ones: the public is challenged by important topics that stimulate discussion and, at the same time, we also want to provide a friendly and relaxed atmosphere where socialization is encouraged during the “Apéros” taking place in the evenings, for instance. Queer Popcorn represents a unique opportunity for the public to discover stories that wouldn’t be screened in our cinemas.
Queer is an umbrella term that indicates the refusal of normative identities, societies or politics. Sexual orientation and gender identity cannot be reduced to binary alternatives. Queer people don’t see the point in defining people as bisexual, homosexual, transgender or heterosexual: what really matters is to be recognized as a person who has the right to live and love without being considered as unequal to the majority.

Queer Popcorn is seeking films and videos that are of interest to lesbian, gay, bisexual, queer, intersex and/or transgender people and/or relate to gender or sexuality issues and/or feature an LGBTQ main character. The entries may be shorts narrative, documentary, experimental and animated. A submission constitutes agreement to our Submission Terms and Conditions.

a. Entry Requirements

We accept entries in the form of BluRays or uploaded online screeners. If you originally submit an online screener and your film is selected for the festival, you will be required to submit other formats of your film for programmer use during the festival in addition to your exhibition copy.

Please note that the DVD copies you submit for entry will not be returned.

READ THESE SUBMISSION TERMS AND CONDITIONS CAREFULLY. SHOULD YOUR ENTRY BE ACCEPTED TO THE FESTIVAL, YOU WILL BE EXPECTED TO AGREE TO THE FOLLOWING TERMS, INCLUDING GRANTS OF RIGHT, INDEMNITY OBLIGATIONS TO US AND MANDATORY ARBITRATION OF DISPUTES. IF YOU DO NOT AGREE, DO NOT SUBMIT A WORK TO US.

In exchange for the opportunity to have the work I submit ("Work") considered for exhibition at the Queer Popcorn Festival ("Festival"), and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I understand that if my project is accepted, I will be expected to agree to:

1. License to Use the Accepted Work. I WILL irrevocably grant to Queer Popcorn, and its parents, subsidiaries and affiliates, (collectively, "Queer Popcorn") an irrevocable, perpetual, world-wide, royalty-free and non-exclusive license (with the right to sublicense and assign) to reproduce, distribute, publicly display, publicly perform, transmit, broadcast, and/or otherwise use and exploit the Work (at its option and in its sole discretion), or any portion thereof (including, without limitation, the right to use footage, stills and/or title of the Work), throughout the universe, in perpetuity, in any and all languages, formats and media, now known or hereafter developed, including but not limited to, all print, television, radio, online, Internet, digital, wireless, and electronic media, in connection with the Festival (defined below), Queer Popcorn web site including, without limitation, (www.queerpopcorn.com), and any advertising, marketing or promotion thereof and for archival and scholarly purposes. The granted rights will include the right to make derivative works for purposes of (1) advertising, marketing and promotional materials; (2) restoration and archival purposes; and (3) complying with technical, format and similar requirements (e.g., for online). "Festival" means any media festivals and similar exhibitions under the auspices of Queer Popcorn. I agree that Queer Popcorn is not obligated to use the Work, or any portion thereof, or any of the rights granted to Queer Popcorn hereunder. If accepted to the Festival, I hereby irrevocably authorize Queer Popcorn to use my name, likeness and biographical information, and I further represent and warrant that I have the authority to provide Queer Popcorn with, and hereby grant the right to use the name, likeness and biographical information for the cast, director(s) and producer(s) of the Work in connection with the exhibition of my film and will provide Queer Popcorn their current contact information upon Queer Popcorn request.

If accepted to the Festival, I hereby agree to waive any right that I may have to inspect or approve Queer Popcorn use of the Work in connection with the Festival, the Queer Popcorn Website and/or the advertising, promotion and/or marketing thereof. I further waive and relinquish any right that I have or may hereafter have in any jurisdiction, to so called "moral rights" or rights of "droit moral" with respect to results and proceeds of the Work and agree, represent and warrant that Queer Popcorn may combine, alter or modify such Work (at its option and in its sole discretion) without the consent of any third party.

2. Archival of the Work. Without limiting the generality of the foregoing, I hereby irrevocably agree that the submission copy may be retained at the Queer Popcorn archive.

3. Representations and Warranties. I hereby represent, warrant and covenant to Queer Popcorn that (i) I have read and agree to the Queer Popcorn Festival Submissions and Participation Rules and these Submission Terms and Conditions, (ii) have the full and legal power and authority to accept these Submission Terms and Conditions and to later grant the rights outlined herein; (iii) no other consents, authorizations or payments are necessary to permit Queer Popcorn full use and enjoyment of the rights granted herein, should my film be accepted; (iv) I will undertake and perform all of my obligations pursuant to these Submission Terms and Conditions in compliance with all applicable federal, state and local rules, laws and regulations; (v) Queer Popcorn use of the Work, and the exercise of the granted rights, shall not infringe upon or violate the copyrights, trademarks, tradenames, rights of privacy or publicity or any other personal or proprietary rights of any person or entity, nor constitute defamation nor otherwise result in any third party liability to Queer Popcorn or its successors, assigns or licensees; and (vi) I have paid and will continue to pay in full all licenses, clearance fees, and any other obligations of any kind necessary for Queer Popcorn full exercise of the granted rights.

4. Indemnities. I hereby agree to indemnify, hold harmless and defend Queer Popcorn and its affiliates, subsidiaries, officers, directors, representatives, successors, assigns, employees, distributors and licensees, and any other partner controlling, controlled by or under common control with such other party (collectively, the “Indemnified Person”) from and against, and the Indemnified Person shall have no liability to you, your representatives or agents, for any and all claims, liabilities, losses, damages and expenses, including without limitation and as incurred, reimbursement of all reasonable costs of preparing, pursuing or defending any such claim or action, including fees and expenses of counsel of the Indemnified Person (collectively, "Losses") whether arising out of pending or threatened litigation, or other action or proceeding, directly or indirectly related to or arising out of, or in connection to any breach or alleged breach by you of any covenants, agreements, representations and warranties made by you in these Submission Terms and Conditions or otherwise in connection with the exercise of the granted rights hereunder.

5. General Legal. These Submission Terms and Conditions contain the full and complete understanding between me and Queer Popcorn (each a "Party," and collectively, "Parties") and supersede all prior and contemporaneous agreements and understandings, whether oral or written. These Submission Terms and Conditions may not be modified or amended except in a writing signed by the Parties (the Coordinator of Queer Popcorn is the only authorized signer of any amendments or modifications). These Submission Terms and Conditions will not be construed as creating a joint venture, partnership, agency or employment relationship between the Parties hereto nor will either Party have the right, power or authority to create any obligation or duty, express or implied, on behalf of the other. Any terms or provisions of these Submission Terms and Conditions which shall prove to be invalid, void or illegal shall in no way affect, impair or invalidate any other term or provision herein and such remaining terms and provisions shall remain in full force and effect.

6. Additional Acts. If accepted, I will execute any documents (after being afforded a reasonable opportunity to review and/or confirm same) and do any other acts as may be reasonably required by Queer Popcorn or its assignees or licensees to further evidence or effectuate Queer Popcorn rights as set forth in these Submission Terms and Conditions.

7. These Submission Terms and Conditions will be governed by the laws of Switzerland applicable to agreements entered into and to be performed entirely in said State (without reference to its conflict of laws provisions), and I irrevocably consent to the jurisdiction and venue of the courts located in Bellinzona, Switzerland.
