PIFF is operated and handheld by KULFI ENTERTAINMENT PRIVATE LIMITED which comes under (Pursuant to sub-section (2) of section 7 and sub-section (1) of section 8 of the Companies Act, 2013 (18 of 2013) and rule 18 of the Companies (Incorporation) Rules, 2014)having their office at 77/D5, Mahada, SVP Nagar, Andheri (West), Mumbai – 400053, (hereinafter referred to as “PIFF”).
2. Please read these Terms & Conditions carefully before using the Website. By accessing any part of the Website, you shall be deemed to have accepted these Terms & Conditions in full, regardless of whether or not you choose to register as a member on the Website. If you do not accept these Terms & Conditions, you must leave the Website immediately.
3. Unauthorized use of this Website may give rise to a claim for damages and/or be a criminal offense.
4. We ensure that the Website is normally available 24 hours a day, PIFF shall not be liable if for any reason the Website is unavailable at any time or for any period. Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance, or repair or for any other reasonable cause.
5. PIFF will use reasonable endeavors to ensure that the Website does not contain or promulgate any viruses or other malicious code. It is recommended that you should check viruses in all such materials and regularly check for the presence of viruses.

You must not use this Website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the Website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

If you breach these terms and conditions in any way, we may take such action as deemed appropriate to deal with the breach, including suspending your access to the Website, blocking computers using your IP address from accessing the Website, contacting your internet service provider to request that they block your access to the Website and/or bringing court proceedings against you.
11. All information and content on this Website are protected by copyright. You are granted a limited, non-exclusive, non-transferable, and revocable license to download, display, and print information and content of this Website.
12. By posting the User Material, You hereby grant PIFF a license to use, display, reproduce, distribute, modify, delete from, add to, prepare derivative works of, publicly perform, and publish such User Material worldwide, including on or through any property, in perpetuity, in any media formats and any media channels now known or hereinafter created.
13. The license You grant to PIFF is non-exclusive, royalty-free, irrevocable, and sub-licensable. Additionally, Pocket Films is free to use any ideas, concepts, know-how, or techniques contained within such User Material for any purpose, including, but not limited to, developing, manufacturing, marketing, and providing commercial products and services. PIFF use of such User Material shall not require any further notice of attribution to You and such use shall be without the requirement of any permission from or any payment to You or any other person or entity. You hereby agree and confirm that the provisions of section 19(4) of the Indian Copyright Act, 1957, shall not apply to this license.
14. These Terms and Conditions, are subject to change or updating by Jio PIFF, at any time without prior notice. The changes may include superseding terms and conditions or specific notices. YOU SHOULD REVIEW THESE TERMS AND CONDITIONS FROM TIME TO TIME TO BE AWARE OF ANY CHANGES THAT ARE MADE.
15. These Terms and Conditions shall be governed and construed in accordance with the laws of India.

Rules

IMPORTANT NOTE FOR SUBMISSION & PARTICIPATION

The festival will not interact with anyone except the submitter and/ or the producer of the film. If any person – be it the actor, writer, director or anyone from the production crew tries to forcibly extract information about the status of the film from the festival authorities, the festival has absolute rights to >>DISQUALIFY THE FILM<< from the competition and/ or screening which you may kindly note. At the same time, the festival may take the decision to ban the production house completely from sending entries to the future editions of the festival.

Open to filmmakers worldwide, all genres and lengths depending on the categories mentioned.

– Filmmakers can submit more than one entry to the festival in any category.
– All films that are not in English must have English language subtitles.
– Each entry must be a separate submission which includes form and payment for each submission.
– The Festival reserves the right to determine the eligibility for any work submitted.
– Entry fees are payable through FilmFreeway payment systems and are non-refundable.
– The decision of the Festival committee will be final and binding.

One of the reasons PIFF is unique is it highlights stories and storytellers that are underrepresented in media. These groups would include female or non-binary, BIPOC, LGBTQIA+, or people with varying abilities. Our program must include prominent representation of characters, stories, and storytellers in aforementioned groups, and must adhere to the below qualifiers. It is one of the film festivals to exhibit diverse and inclusive productions both – in front of and behind the camera from all over the world.

COMPETITION
PIFF is a competitive event and unless notified otherwise, all films officially selected are eligible for competition. For a list of competitive categories, please see our awards page. All films are nominated and voted upon by an impartial jury of filmmakers, industry professionals, festival programmers.

HOW TO SUBMIT:

Applicants must fill out the questions and pay the submission fee on FilmFreeway and direct account payment.
Applicants may either
(a) upload the screener onto FilmFreeway,

(b) email a streaming link of the film to BFF Organizer at the email address: primeiff@gmail.com

Organizer is not responsible for submissions that are lost, stolen, or damaged in transit. It is the sole responsibility of the Applicant to ensure the streaming link or DVD, as applicable. Please include the entry number (the entry number is provided when you complete the FilmFreeway submission and pay the fee) and the film title clearly on the DVD or the body of the email.

SCREENINGS DURING THE 2021 FESTIVAL:
Applicants acknowledge that PIFF Organizer has the sole right to select the submissions that will be showcased, exhibited, and/or part of the competition at the 2021 Festival and has the sole right to reject submissions. Applicants that are selected must grant to PIFF Organizer the limited license to screen/ exhibit the Film at the 2021 Festival, currently scheduled for 25-26 SEP 2021, in and on a virtual streaming platform; All ticket sales and proceeds are property of PIFF Organizer.

PUBLICITY DELIVERABLES:

If a film is selected for the 2021 Festival, the Applicant will deliver Publicity Deliverables to PIFF Organizer. PIFF Organizer will notify the ARs of the selected films with details of how to deliver and the due dates of the Publicity Deliverables. “Publicity Deliverables” are the trailer of the film, the Film’s digital poster, and at least two stills from the Film.

By submitting a Film to the 2021 Festival, Applicant permits PIFF Organizer and Festival Entities to use the following:

the Film’s title, the Film’s synopsis and other Publicity Deliverables, and any of the principal cast members, director(s)’s, writer(s)’s, producer(s)’s, crew members’ names, voice, biographical information, and/or likeness, in the following media:

PIFF’s Website, PIFF’s Social Media (including Twitter, Instagram, Facebook, Youtube), and press releases throughout the universe, in perpetuity, without compensation, permission, or notification, solely for the purpose of advertising, publicizing, and promoting the Prime international Film Festival and the Film’s screening at the 2021 Festival.

Applicant represents and warrants that all Publicity Deliverables delivered to PIFF Organizer are legally cleared for such above-mentioned purposes.

DISPUTE RESOLUTION:

Entrant expressly acknowledges and agrees that the Prime international Film Festival shall be entitled to an injunction or other equitable relief (“Relief”) to restrain, prevent or enjoin any breach of this agreement by Applicant.

Without in any way limiting the provisions or scope of the agreement set forth above, Applicant further agrees that any claim, dispute or controversy arising out of, in connection with, or otherwise related to the Film, the Festival, or these Rules and Regulations, including, without limitation, any claim or cause of action of any nature arising from the actual or alleged breach, termination, enforcement, interpretation or validity of these Rules and Regulations, as well as the determination of the scope or applicability of this agreement to arbitrate, will be governed by the internal, substantive laws of the State of Maharashtra and will be subject to and submitted to exclusive, binding arbitration before a single arbitrator in Mumbai Maharashtra, which shall be the sole and exclusion forum for determination of such claim, dispute or controversy.
