2026 NORTHERN PLAINS INDIGENOUS FILM FESTIVAL (NPIFF) SUBMISSION TERMS AND CONDITIONS:
The undersigned, who is the authorized representative of the Film named below (the “Film "), submits it to Northern Plains Indigenous Film Festival (NPIFF) for consideration for the 2026 film festival. By submitting, the undersigned confirms they have read, understood, and agree to the following terms:
Representation and Authorization: The undersigned confirms they have the authority to submit the Film on behalf of all owners. They ensure that the Film will not violate any laws or rights of others and that there are no ongoing legal disputes regarding ownership. The undersigned will not enter into any agreements that conflict with these terms.
Intellectual Property Compliance: The undersigned guarantees that the Film will not infringe on any copyrights, patents, or any personal rights of others. All associated fees will be paid promptly.
Exhibition Rights: Acceptance of the Film by NPIFF does not create a confidential relationship, nor does it obligate NPIFF to provide any compensation unless awarded as part of the Festival. Selection does not imply endorsement of the Film or its content.
Indemnification: The undersigned agrees to protect NPIFF and its associates from any claims or expenses relating to the Film or any breach of these terms.
Voluntary Submission: The undersigned submits the Film voluntarily and understands that NPIFF is not obligated to accept, exhibit, or return any materials related to the Film.
Waiver of Claims: By submitting, the undersigned and Film’s Owners waive any rights to bring claims against NPIFF related to the submission or exhibition.
Limitation of Remedies: If any claims arise, the maximum remedy available will be a refund of the submission fee, with no other damages or relief available.
Rights Granted: If accepted, the undersigned grants NPIFF and its affiliates the right to use footage, images, and information from the Film for promotional purposes, including the right to use names and biographical data of all Film personnel.
Festival Benefits: Any contractual obligations regarding benefits associated with the Festival will be managed solely by the undersigned and/or Film Owners, without any involvement or responsibility from NPIFF.
No Guarantees: NPIFF does not guarantee selection or provide assurances regarding the submission review process.
Digital Asset Access: The undersigned grants NPIFF the right to access and use all digital assets related to the Film, which will be protected by reasonable security measures.
Consent for Minors: If the undersigned is a minor, they confirm that written consent from a parent or guardian has been provided.
Governing Law and Arbitration: Any disputes arising from these terms will be governed by North Dakota law and resolved through binding arbitration in Fargo, ND.
Legal Consultation: The undersigned has the right to consult with an attorney regarding these terms before submitting the Film.
Community Standards: NPIFF promotes a respectful environment free from harassment and discrimination. Any violation may lead to disqualification from participation.
Acknowledgment of Rules: The undersigned acknowledges reading and understanding the submission rules, which take precedence over any other sources.
Acceptance of Terms: By submitting, the undersigned and all Film Owners fully accept these terms without reliance on any other representations.
Festival Participation Agreement: If accepted, the Film Owners will enter a binding Festival Participation Agreement that incorporates these terms. NPIFF retains the right to revoke acceptance if this agreement is not accepted.
