MARSAI FESTIVAL REGULATIONS

ARTICLE 1. ORGANIZERS OF THE MARSAI FESTIVAL

The organization of the “MarsAi Festival” (hereinafter referred to as the “Festival”) is ensured by the company MobilEvent, registered with the Paris Trade and Companies Register under number B 484 171 525, whose registered office is located at 4, impasse Truillot, in Paris (75011), represented by Mr. Bruno SMADJA, manager and the company La Plateforme Formation, registered under number SIRET 88378049600013, whose registered office is located at 15 traverse Canoubier, 13007 Marseille, represented by Cyril Zimmermann, president

(hereinafter referred to as the “Organizers”)

ARTICLE 2. DURATION OF THE FESTIVAL

The 2026 edition of the MarsAi Festival will take place between April 1, 2026 and June 19, 2026.

Registration for the MarsAi Festival is open from April 1, 2026 at 00:00 to June 1, 2026 at 23:59, French date and time (metropolitan France), via the Organizers’ website www.marsaifestival.com

ARTICLE 3. CONDITIONS OF PARTICIPATION

3.1 Registration for the Festival implies the express and unreserved acceptance of these regulations in all their provisions.

3.2 The Participant must be a natural person of legal age (18).

3.3 The Participant must create a video (hereinafter referred to as the “Video”) of a maximum duration of 1 (one) minute created entirely or partially using Artificial Intelligence tools.

The Video created by the Participant must be a personal creation. It must have been created by the Participant himself/herself with the help of Artificial Intelligence tools.

The Participant is invited to respect the following recommendations for the creation of his/her Video:

Formats MP4 (H264), MOV, WMV, AVI
Resolution 16/9: 1280×720 pixels per line or 1920×1080 pixels per line
200 MB maximum

Furthermore, the Participant must include in the credits the name of the author and the source of any work, in particular musical, incorporated into the Video.

The Participant is invited to indicate, for information purposes in the registration form, the artificial intelligence tools used in the creation of his/her Film.

The use of artificial intelligence does not in any way exempt the Participant from respecting the rights of third parties.

3.4 Within the deadlines provided for in Article 1 of these regulations, the Participant must complete and send via the Internet to the Festival the registration form available on the Organizers’ website http://www.marsaifestival.com.

All fields of the registration form marked “mandatory” with the symbol * must be completed for the registration to be validated.

The Participant must also upload 2 (two) photographs, one to represent his/her Video on the Organizers’ website, the other to represent the Participant and/or his/her team.

To finalize his/her registration for the Festival, the Participant must finally upload his/her Video in the area provided for this purpose.

The Participant has however the possibility to send one or several Video(s) by completing a new form for each registration. Each Video sent will count as one participation.

Any Participant who has sent a Video to the Organizers without being its author will have his/her participation declared null and void.

To validate his/her registration, the Participant must deliver at the time of registration 2 SRT files corresponding to the subtitles of the proposed film, one in the original language of the film, the other in English.

All “speaking” films which do not have 2 SRT files will not be validated and consequently will not be taken into account in the selection.

Upon effective receipt of the Video, the Organizers will send the Participant an email confirming receipt of his/her Video and validating his/her registration for the pre-selection.

Following the validation by the Organizers of the Participant’s registration to the Festival, his/her Video(s) may be put online by the Organizers and will be accessible on their website http://www.marsaifestival.com.

From that moment, the Participants will not be able to request the withdrawal or modification.

The Participants authorize the Organizers to carry out all verifications concerning their identity and their contact details.

Any registration presenting an anomaly (incomplete, erroneous, …) or contrary to public order or good morals or validated after the end of the Festival will not be taken into consideration and any identification of false or incomplete identity or contact details will result in the immediate elimination of the Participant.

Any participation contrary to this article will be considered null and void.

More particularly, any fraud, or attempt of fraud, manifested by a beginning of execution and committed with the aim of unduly obtaining a prize, or the non-respect of these regulations, or any malicious intention to disturb the course of the Festival, may give rise to the exclusion of its author, the Organizers reserving the right to initiate legal proceedings against him/her.

ARTICLE 4. SELECTION AND DETERMINATION OF WINNERS

4.1 The Organizers will first carry out an official selection (hereinafter referred to as the “Official Selection”) of around fifty Videos among all the Videos sent by the Participants and validated by the Organizers.

This Official Selection will then be put online on the Organizers’ website http://www.marsaifestival.com as well as on Facebook, YouTube, Instagram, TikTok pages, and all video platforms dedicated in particular to the MarsAi Festival, or on any other website dedicated to the MarsAi Festival and its partners.

4.2 The jury will designate several winners among the Official Selection carried out by the Organizers.

The jury will be composed of professionals of cinema and image.

The winners will receive the following prizes:

The Grand Prize
The Screenplay Prize
The Directing Prize
The Desirable Future Prize

The announcement of the winners will take place during the MarsAi Festival ceremony on June 19, 2026.

ARTICLE 5. AUTHORIZATIONS OF EXPLOITATION
5.1 The Participants assign, free of charge and on a non-exclusive basis, for the whole world and for a duration of 3 (three) years from their registration to the Festival according to the terms of Article 3 above, to the Organizers, the right to publish their surname, first name, city and department of residence, their photograph (hereinafter the “Image of the Participant”) on any medium and by any process known and/or unknown to date (notably social networks, internet and intranet sites, press and television) within the framework of the Festival, without limitation of the number of reproductions and/or broadcasts of the Image of the Participant.
The Participant guarantees the Organizers that he/she is not bound by a contract relating to the use and/or exploitation of his/her Image. Consequently, he/she guarantees the Organizers against any recourse and/or action that may be brought by natural or legal persons who would consider having any rights whatsoever to assert over the use and/or exploitation of his/her Image and who would be likely to oppose its reproduction and/or broadcasting.
5.2 Subject to the contributions which may have been made to a collective management organization for musical works, the Participants also assign free of charge and on a non-exclusive basis to the Organizers the right to reproduce and represent, cause to be reproduced, cause to be represented and broadcast, cause to be broadcast their Videos in their entirety or by extracts, associated or not with other audiovisual programs, on an institutional, promotional or commercial basis, for the whole world and for a duration of 3 (three) years from their registration to the Festival:
on the Organizers’ Site (www.marsaifestival.com) in its web and mobile versions
on the Facebook, YouTube, Instagram, Linkedin, Tik Tok pages dedicated notably to the MarsAi Festival and all other video platforms,
on all internet, mobile and tablet sites of the partners of the MarsAi Festival event,
as well as on all other internet sites chosen by the Organizers for the promotion of the MarsAi Festival.
Generally speaking, the Organizers thus have free of charge the non-exclusive right, within the territorial and duration limits stated above, to reproduce, represent, use, exploit, circulate, broadcast and/or communicate to the public or to a category of public, free of charge and/or for payment, in the commercial and non-commercial sector, for a promotional and/or advertising purpose, directly or through an intermediary of their sole choice and duly authorized for this purpose, the originals, duplicates and/or copies of the Videos in all forms (entirety, extracts, still images, screen captures, soundtrack), in all languages, dubbed and/or subtitled, intended for all fixed and/or mobile receivers (notably, mobile telephone, iPad, PDA, monitor) by all means known or unknown to date and, notably, by television broadcasting (notably by hertzian means, analogue, digital terrestrial, cable, satellite, ADSL, catch’up, preview, pay per view, streaming, IPTV, Connected Television, SMAD, etc.), in cinemas, in video on demand (VOD, AVOD, FVOD, SVOD, DTO, EST, etc.) and/or other digital online transmission on individual demand or not by all wired or wireless electronic communication processes (notably, Internet), with a view to temporary and/or definitive viewing and/or downloading, by sale, loan and/or rental intended for the private use of the public in the form of commercial videograms, in the form of public representation, in the form of making-of, in the form of bonuses, in the form of extracts (notably, intended for a welcoming work), in the form of trailers and this, including in educational, cultural and institutional networks, the network of the French Ministry of Foreign Affairs and in closed circuits (planes, boats, hotels, prisons, etc.).
The Organizers ensure that they respect and cause to be respected the moral rights attached to the Videos and to the musical works incorporated.
In consideration of the above, each Participant expressly declares recognizing and accepting that his/her Video or Videos, within the framework of the exploitations provided for in this Article 5, may be compiled with one or several Videos of one or several other Participants and this, subject to the respect of his/her moral right.
In order to proceed with the broadcasts referred to above, the Organizers may reproduce the Videos, use extracts thereof and adapt them exclusively for reasons of ergonomic, technical and graphic constraints of reception terminals and means of transmission.
The assignments mentioned above being made on a non-exclusive basis, the Participants undertake not to assign these same rights exclusively to third parties for the duration and the territory mentioned above.
ARTICLE 6. DETERMINATION OF PRIZES
6.1. The Jury Prizes:
The “Grand Prize” rewards the director of one of the Videos participating in the Festival.
The winner of the “Grand Prize” will win 10,000 (ten thousand) euros to finance all or part of the production of his/her short film, and will benefit from the support of a producer to carry out his/her project, subject to the conditions defined below:
This short film must be produced within a period of one year from the awarding of this Prize to the Participant.
The winner of the “Grand Prize” will not receive this amount directly. This amount will in fact be made available to a producer chosen by the Organizers, who will allocate all of it to the production and to the charges and costs of the producer of the short film of the winner of the “Grand Prize”. Prior to the launch of the production of the short film, the winner of the “Grand Prize” and the producer will conclude a production contract determining the remuneration of the winner of the “Grand Prize”. In the absence of agreement between the parties on the terms of this production contract within a period of three months from the designation of the winner of this Prize, the Organizers will regain their freedom to award the “Grand Prize” to another Participant, after consultation with the jury.
This amount will be paid to the producer once the financing plan of the short film has been finalized in the following manner: 50% (fifty percent) no later than 7 days before the start of shooting and 50% upon delivery of the final copy of the completed film.
The winner acknowledges that the allocation of this amount has as its sole purpose the financing of a short film. Consequently, if, for any reason whatsoever, the short film is not completed and ready to be distributed by the aforementioned date, the amount will be forfeited by the winner of the “Grand Prize” and by the producer, who will have to reimburse it to the Organizers, and this amount will be awarded again at the next edition of the MarsAi Festival.
The “Screenplay Prize” rewards the director of one of the Videos participating in the Festival.
The “Directing Prize” rewards the director of one of the Videos participating in the Festival.
The “Desirable Future Prize” rewards an actor in one of the Videos participating in the Festival.
6.2 General provisions:
The winners will be informed of their prize by electronic mail, sent to the email address provided in the registration form, as soon as within 15 days following June 19, 2026, and will have a period of 3 (three) days to confirm that they accept their prize.
A winner who does not come forward within the aforementioned period of 3 (three) days following the sending of the email will be considered as having renounced his/her prize. In this case, the Organizers may designate an alternate winner.
The winner will also lose any right to his/her prize in the event that the information provided by him/her in the context of participation reveals that he/she does not meet the conditions of participation of these regulations. In this case, the prize will remain the property of the Organizers who reserve the right to reassign the prize.
Furthermore, the Organizers cannot be held responsible if the email address of the winners entered in the registration form during their participation in the Festival is not valid, does not function or if the mailbox of said winners is full and prevents the reception of the email informing them that they have won one of the prizes described in Article 6 above.
The prizes offered cannot give rise on the part of the winners to any dispute, nor claim of any kind.
Before receiving their prize, the winners must meet the conditions defined in these regulations and justify their identity.
ARTICLE 7. RESERVATION OF EXTENSION, MODIFICATION OR CANCELLATION
The Organizers reserve the right to shorten, extend, modify or cancel the Festival, if circumstances require it or in case of force majeure. Their liability cannot be engaged for this reason.
Addenda to these regulations may possibly be published during the duration of the Festival. They will be considered as appendices to these regulations accepted by the Participant upon his/her registration
ARTICLE 8. DATA PROCESSING AND FREEDOMS
All the information that the Participant communicates when registering for the Festival is intended for the Organizers.
Subject to the provisions of Article 5 and unless expressly requested otherwise by the Participants, the Organizers will therefore be the sole recipient of the personal data indicated by the Participants in the registration form for the Festival, unless the Participant has agreed to receive offers and information from the commercial partners of the Organizers. The contact details of the Participants and of the winners will be processed in accordance with the provisions of law no. 78-17 of January 6, 1978 relating to data processing, files and freedoms.
They will benefit from a right of access and rectification relating to the data concerning them by writing to the email address (contact@marsaifestival.com) or to the following postal address:

ARTICLE 9. GUARANTEES
9.1 Intellectual property rights
Any Participant declares to be duly the owner of all the rights of reproduction, representation and distribution of his/her Video without condition or reservation and guarantees having obtained all the necessary authorizations for the distributions referred to above. In this respect, the Organizers remind that the use, even partial, of musical works or other pre-existing works in a Video requires the authorization of the rights holders of these.
Upon first request of the Organizers, the Participant must communicate to them the necessary authorizations from the rights holders.
Each Participant also undertakes not to copy, even partially, an existing model or to make appear any distinctive sign (notably trademark, design and model…) and to comply with the laws relating to copyright (articles L.111-1 et seq. of the Intellectual Property Code).
Any Participant is personally solely responsible for all the agreements necessary for the production and communication of his/her Video(s) and guarantees having borne all the authorizations of any natural and/or legal person having participated directly or indirectly in the production, realization, promotion and/or exploitation of his/her Video (and, notably, its authors, directors, performers, co-producers, composers, musicians, publishers, technicians and/or other partners and/or rights holders).
Upon first request of the Organizers, the Participant must communicate to them the necessary authorizations of the persons referred to above.
In this respect, any Participant guarantees the Organizers against any claim or action and/or payment that may be brought and/or requested on any grounds whatsoever by the rights holders and/or persons referred to in this article 9.1, as well as by any natural and/or legal person who has not participated in the production of the Video but who would consider having any rights whatsoever (notably personality rights, rights on trademarks, logos, signs…) to assert with regard to the production and exploitation of the Video.
9.2 Image rights and privacy
The Participants undertake not to contravene the provisions relating to image rights and privacy (article 9 of the Civil Code) and, more generally, all the legislative and regulatory provisions in force.
The Participants must therefore personally ensure the agreement of the person(s) filmed, or of his/her parents or legal guardian if it concerns a minor, for the purpose of putting online the Video in which this or these person(s) appear, as well as the acceptance of the conditions of these regulations.
9.3 General guarantee
Consequently to the provisions mentioned above, the Participant guarantees being validly holder of the rights assigned in Article 5 above as well as of all the authorizations necessary for the aforementioned exploitations. He/she thus guarantees the Organizers against any claim or action of third parties relating to the Video broadcast.
The Organizers shall therefore not incur any liability in the event of a claim made by a third party and the said Participant undertakes to bear all the damaging consequences which may result, for the Organizers, from the use, in any capacity whatsoever, of the Video that he/she has transmitted within the framework of the Festival as being his/her own creation.
Notwithstanding the above, any Participant expressly guarantees to the Organizers the free and peaceful exercise of the rights granted and notably:
that he/she has full power and capacity to grant the rights assigned herein and that these rights are neither nor will be in any way and in an exclusive manner mortgaged, given as a guarantee, encumbered by any servitude, nor devolved in favor of a third party;
that he/she has not done and will not do, by the fact of an assignment to a third party or by any other means, any act likely to compromise the present authorization, or likely to prevent or hinder the full enjoyment of the rights granted to the Organizers, or any third party of their choice under the conditions set out in Article 5 above;
that he/she does not introduce into the Video any reproduction or reminiscence likely to violate the rights of third parties and to give rise to actions for plagiarism and/or infringement;
that to his/her knowledge no dispute or legal action is in progress, or is about to be initiated, relating to the rights assigned to the Organizers under these provisions.
The Participants are personally responsible both towards third parties and towards the Organizers for the non-observance of the above stipulations and guarantee the Organizers against all disturbances, claims or actions which could result from this non-observance. The Participants will personally deal with and assume the burden of all payments which could be due or claimed from the Organizers in this respect.
The Participant guarantees that the possible use of artificial intelligence tools in the creation of the Film complies with the intellectual property rights of third parties, notably with regard to the contents used for the training or the generation of the elements of the Film.

ARTICLE 10. LIABILITY
The Organizers cannot be held responsible for a delay and/or an error in the routing of mail or prizes, for the loss of these during their dispatch, for their non-receipt or for their deterioration for the winners who wish to receive their prizes by mail.
The Organizers incur no liability in the event of a complaint or dispute relating notably to the conformity and/or quality of the prizes won.
The Organizers shall incur no liability whatsoever in the event of an incident or accident occurring on the occasion of the use and/or enjoyment of the prizes won.
The Organizers incur no liability notably because of the occurrence of a case of force majeure or of an event beyond their control such as: a malfunction, an interruption or a slowdown of postal services, means of transport or the telecommunications network.
Likewise, the Organizers may under no circumstances be held responsible, this list not being limitative:
For the content of the Videos transmitted by the Participants and consulted on the Site;
For the transmission and/or reception of any data and/or information on the Internet;
For any malfunction of the Internet network preventing the proper running/functioning of the Festival;
For the failure of any receiving equipment or communication lines;
For the loss of any paper or electronic mail and, more generally, for the loss of any data;
For routing problems;
For the functioning of any software;
For the consequences of any virus, computer bug, anomaly, technical failure;
For any damage caused to a Participant’s computer in the Festival;
For any technical, hardware and software failure of any nature whatsoever, having prevented or limited the possibility of participating in the Festival or having damaged the system of a Participant.
The liability of the Organizers may not be incurred, in a general way, if for reasons of force majeure or fortuitous event beyond their control, the Festival should be postponed, modified or cancelled.
In accordance with the provisions of Article 9 above, the Organizers may in no event be held responsible for any infringement of third-party rights by the Videos.
In accordance with the law for confidence in the digital economy of June 21, 2004, in the event of a judicial requisition or claims by rights holders, the Organizers and/or the partner of the latter will be required to remove the disputed Videos. The Organizers and/or the Partner will turn against the internet users concerned.

ARTICLE 11. DISPUTES
These regulations are subject to French law.
In the event of difficulty of interpretation of these regulations or in the event of a dispute, only the courts of the jurisdiction of the Court of Appeal of Paris will have jurisdiction.
