The Inner City Short Film Festival is all about storytelling and the documentation, exhibition, collection, preservation and study of the stories not only the filmmakers will share, but every awardee, presenter, viewer and participant will share. This entire event and its content will be recorded as a part of our Cultural Legacy Project and ultimately housed in the Los Angeles Inner City Cultural Center C. Bernard Jackson Memorial Library, "A Place Where You Check Out Art or Check Art In.™".
This new facility will house the collected works of co-founder, artistic and executive director C. Bernard Jackson (d), Inner City alumni and LA based artists, arts organizations and other cultural workers like you.
Your participation means so much to us as we look forward to the next half century. As C. Bernard Jackson aka as Jack Jackson said at the beginning of the Inner City journey "Art may be the only tool we have left to save ourselves from destruction."
So, if we do not tell our stories and house them for our current and future posterity, who else will? This is how we will save ourselves, our progeny and ensure our life's work, culture and history is secured. Thank you for being a part of the Inner City Cultural Center journey.
There will be approximately twelve (12) winners of the Contest. The number of winners is subject to change and to be determined by Sponsor, in Sponsor’s sole discretion. Each winner will receive one (1) prize. The following prizes will be awarded to the winners of the Contest: First and second place receive a trophy and the film short will be exhibited at the Festival. Honorable Mention will receive a medallion and the film short will be exhibited at the Festival. The remaining film shorts selected for exhibition at the Festival will receive a certificate of participation. Those film shorts not exhibited at the festival will receive a certificate of participation and will be exhibited by The Los Angeles Inner City Cultural Center (LAICCC) through its website, and YouTube Channel, and housed in the Cultural Legacy Project – The LAICCC/C. Bernard Jackson Memorial Library for future programs and exhibitions.
The Los Angeles Inner City Cultural Center is sponsoring a Contest to select film shorts to exhibit at “The Inner City Short Film Festival and Awards Show”. It's scheduled to take place digitally via online live streaming.
The Contest is open only to individuals who (1) are eighteen (18) years of age or over as of the first date the Contest Period begins (as described below) (2) have a valid email address, and (3) have had some experience in connection with Sponsor.
CONTEST PERIOD / ENTRIES / HOW TO ENTER
The Contest will begin Tuesday, August 4, 2020 at 12:01:00 am Pacific Standard Time (“PST”) and end on Saturday, October 4, 2020 at 12:00:00 am PST (the “Contest Period”). To be valid, all entries must be received after the Contest has started and no later than by Friday, October 3rd, 2020 at 11:59:59 pm PST.
Below is a description of how to enter the Contest:
1. CREATE A FILM SHORT
Create an original film short of an “Inner City Ditty”. An “Inner City Ditty” is a story or recollection of an experience with Sponsor that has had an impact or important influence on an entrant's life. In addition to the foregoing, the film short must (a) be previously unreleased, (b) be created specifically for this Contest only, (c) reference or otherwise be a reflection of Sponsor, (d) be in English or have English subtitles at the time submitted, and (e) not exceed five (5) minutes. If an entry film short does not meet all of the foregoing criteria, it will be disqualified.
2. ENTER THE CONTEST AND SUBMIT THE FILM SHORT
Each individual film short submission requires a nonrefundable entry fee of twenty dollars, payable at the time of submission. To submit a film short, each entrant shall upload their Short film on FilmFreeway.
RIGHTS TO FILM SHORT; NAME AND LIKENESS
By entering the Contest, each entrant grants to Sponsor the irrevocable non-exclusive right, throughout the Universe in perpetuity, to upload, reproduce, distribute, transmit, exhibit, display, perform, promote, store, share, make available, and otherwise use all submitted film shorts by means of all media whether now known or hereinafter devised for non-commercial (i.e. not-for-profit) uses in connection with Sponsor. Notwithstanding anything to the contrary contained herein and for clarity, each entrant agrees and understands that using the film shorts in connection with Sponsor’s marketing, promotion, and/or fundraising efforts qualify as non-commercial uses and Sponsor shall have the right to use the film shorts in such manner. Additionally, by entering the Contest, each entrant grants to Sponsor the irrevocable non-exclusive right, throughout the Universe in perpetuity, to use, publish, and to permit others to use and/or publish entrant’s name (legal and professional), voice, likeness, and/or biographical material in connection with the film shorts, Contest, and/or Festival without further compensation. The shall apply with equal force and effect to any other party that contributed to each entrant film short in any way. Without limiting anything contained herein, the foregoing grant of rights does not transfer the copyrights in any of the film shorts to Sponsor. Each entrant expressly reserves all rights not granted in these Official Rules.
By entering the Contest, each entrant agrees to execute and deliver to Sponsor any licenses, contracts, documents, or instruments of transfer as may be necessary or desired to effectuate any of the rights granted in these Official Rules, promptly upon Sponsor’s request and without further consideration. Without limiting the foregoing, such documents may include, but are not limited to, a release of liability, declaration of eligibility, and a publicity consent agreement.
EMAIL CHANGE OF ADDRESS POLICY
Sponsor and its agencies are not responsible for lost, interrupted, or unavailable network, server, or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical, or electronic; including without limitation, the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen,misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries will not be returned. In case of dispute as to identity of a winner, such entry will be declared made by the individual sending the email to Sponsor (as described above) at the time the entry was submitted, and if a prize is won and such individual is a valid entrant, the prize will be awarded to such individual.
Entrants are only eligible to win a maximum of one (1) prize per individual. An entrant is defined as the person who submitted the email (as described above). If multiple emails are sent for the same individual or film short, only the first email will be recognized as a valid entry, subject to meeting the eligibility requirements set forth herein. Winners are solely responsible for any local, state, or federal income taxes on prizes.
First and second place winners will have an opportunity to give a one (1) minute acceptance speech at the Festival. Such winner(s) may either (a) pre-record such acceptance speech that Sponsor will then exhibit at the Festival, (b) give such acceptance speech by virtual presentation digitally via online live streaming, (c) elect for Sponsor to read a written version of such acceptance speech at the Festival, or (d) elect for Sponsor to state that such winner cannot be present, so Sponsor will accept the prize on their behalf.
In the event that any such acceptance speech exceeds one (1) minute, Sponsor reserves the right, in Sponsor’s sole discretion, to end/terminate such speech after the initial one (1) minute period. Entrants and winners are not required to attend the Festival. All other entrants who satisfied eligibility as described herein, but are not selected as a winner, will receive a certificate of participation. There is no limit on the number of such entrants.
SELECTION OF THE WINNERS
Sponsor will assemble two (2) committees that will be involved in the selection of the Contest’s winners: The “Selection Committee”; and “Awards Committee”. Both committees shall consist of individuals who are authorized representatives and/or agents of Sponsor. The Awards Committee shall contain individuals who have experience in the film and/or performing arts industries. Sponsor will determine the individuals who will serve on the Selection Committee and Awards Committee (such individuals are hereinafter referred to individually and collectively as, the “Committee Members”) in Sponsor’s sole discretion, and has no obligation to disclose the identities, names, contact information, and/or any other information of any Committee Members. Sponsor aims to select Committee Members on the basis of qualifications and will make every attempt to avoid favoritism and conflicts of interest in the selection of Committee Members.
At the end of the Contest Period, the Selection Committee will review each entry to determine eligibility. The Selection Committee shall complete such review by Thursday, October 8, 2020. Thereafter, the Awards Committee will review eligible entries, choose the winners, and complete its review by Friday, October 16, 2020. The Awards Committee will choose the winners judging by the following criteria:
(1) Reflects Sponsor’s Core Values (as defined below): Twenty-five percent (25%);
(2) Writing: Twenty-five percent (25%);
(3) Directing: Twenty-five percent (25%);
(4) Film technicality: Fifteen percent (15%); and
(5) Originality/creativity: Ten percent (10%);
Sponsor’s “Core Values” are as follows: Sponsor is committed to the development, financing, and operation of an artistic and cultural center in the central Los Angeles area for the presentation and study of the visual and performing arts where Sponsor’s specific and primary purpose is to make available to the minority groups residing in the area the finest performing and the other arts and to furnish to such groups an outlet and facilities for the development of their talents and capabilities. Sponsor has no obligation whatsoever to disclose (a) feedback, reviews, comments, notes, and/or opinions of Committee Members and/or Sponsor, (b) additional details regarding the submission review or selection process, and/or (c) any other information beyond the information set forth in these Official Rules. Sponsor expressly disclaims any liability or responsibility for any and all feedback, reviews, notes, comments, and opinions expressed by Committee Members and/or Sponsor’s representatives in connection with submitted film shorts.
First and second place winners will be announced prior to the Festival. Such winners agree to keep such announcement strictly confidential until after the Festival. After being notified of winning and prior to the Festival, such winners agree to notify Sponsor of whether they will attend the Festival and the manner of their acceptance speech. Honorable mention winners (including the first and second place winners) and entrants who are not selected as winners, but will receive a certificate of participation (as described above) will begin to be notified by Saturday, October 17, 2020.
By accepting and/or using the prize, each winner agrees and acknowledges that Sponsor, its affiliates, and each of Sponsor’s successors, licensees, and assigns may photograph, film, and/or record him/her (including without limitation, each winner’s legal and professional names, likeness, any personal identifying information which Sponsor may gather, voice, conversations, and/or any sounds each winner makes) (individually, and collectively, the “Likeness”) in connection with the Festival and may edit, enhance, recreate, and/or modify the Likeness and include it in the Festival and in connection with the development, production, distribution, advertising, publicity, promotion, and exploitation thereof, in any and all means and media, now known or hereafter devised and in all languages, throughout the Universe in perpetuity. Each winner’s appearance and performance in and in connection with the Festival, Likeness, and all the results and proceeds of each winner’s services from inception hereunder (but specifically excluding winners’ film shorts) (hereinafter collectively, the “Property”) are specially ordered or commissioned by and for Sponsor for use as a contribution to a collective work, compilation, or as a part of an audiovisual work and are a “work made for hire” (as defined in Section 101 of Title 17 of the United States Code) by and for Sponsor. Accordingly, each winner agrees and acknowledges that Sponsor is the sole and exclusive author and owner of all copyrights and all other rights in and to the Property.
If for any reason the Property is determined at any time not to be a “work made for hire”, then each winner hereby irrevocably transfers to Sponsor, throughout the Universe in perpetuity, all rights of every kind and nature in and to the Property. If needed, each winner hereby irrevocably coupled with an interest grants Sponsor a limited power of attorney, to effectuate such a transfer. Additionally, without limiting the foregoing, each winner hereby waives any moral rights to the Property.
If an entrant believes that he/she is the winner of the Contest, such entrant can email Sponsor to inquire, however, the winners will be determined and notified as described in these Official Rules. Sponsor shall have the final determination of the winners and no disputes will be recognized. Winners may be required to sign and return additional documents (as described above), all within ten (10) days of acknowledged notification of Sponsor’s request for such additional documents.
If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return additional documents that Sponsor may require, the prize may be forfeited and Sponsor may select an alternate winner. A list of the winners of the Contest will be announced on Sponsor’s website.
Individuals under eighteen (18) are strictly prohibited from participating in the Contest and should not under any circumstance provide any personal information about themselves to Sponsor. Anyone who provides their personal information to Sponsor or otherwise represents and warrants that they are eighteen (18) years of age or older. If Sponsor learns that Sponsor has collected personal information from a child under age thirteen (13), Sponsor will delete that information as quickly as possible.
REPRESENTATIONS AND WARRANTIES
Each entrant represents and warrants that the film short which entrant submits to Sponsor for consideration in the Contest and all content in connection with such film short (1) is an original work by entrant, or entrant has obtained all rights, licenses, consents, and permissions necessary in order to use, and (if and where relevant) to authorize Sponsor to use such film short pursuant to these Official Rules, (2) does not and will not violate the rights of any third party, including but not limited to, any intellectual property rights, performers’ rights, rights of privacy or publicity, or rights in confidential information; (3) does not and will not create any liability on the part of Sponsor, its subsidiaries, affiliates, successors, and assigns, and their respective employees, agents, directors, officers and/or shareholders. In addition to the foregoing, each entrant represents and warrants that they are legally permitted to enter into these Official Rules and to grant Sponsor all the rights granted in these Official Rules, and these Official Rules will not interfere with any contract to which entrant is a party.
By participating in this Contest, each entrant agrees to indemnify and hold Sponsor, its affiliates, subsidiaries, directors, officers, employees, agents, partners, and licensors harmless from any and all losses and damages (including, but not limited to, attorneys’ fees, expert fees, expenses, and costs) arising out of or connected with any breach by entrant of any warranty, representation, or term of these Official Rules, and/or resulting from claims made against Sponsor by third parties for Sponsor using the film shorts in any manner as provided herein.
GENERAL TERMS AND CONDITIONS
By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor,agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (1) Late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, or postage-due entries; (2) Telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (3) Failed, incomplete, garbled, or delayed computer transmissions; (4) Any condition caused by events beyond the control of the Sponsors that may cause the Contest and/or Festival to be disrupted or corrupted; (5) Any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize or from participation in the Contest and/or Festival; or (6) Any printing or typographical errors in any materials associated with the Contest and/or Festival.
Sponsor reserves the right, in their sole discretion, to suspend, cancel, or modify the Contest and/or Festival for any reason whatsoever, which reasons shall include, but are not be limited to, computer virus, bug, or other technical problem that corrupts the administration, security, or proper administration of the Contest and/or Festival, tampering, fraud, unauthorized intervention or other causes beyond Sponsor’s control, or corruption of the administration security, integrity, or fairness of the Contest and/or Festival. By participating in the Contest, each entrant agrees to release and hold Sponsor and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest, Festival, and/or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, copyright, and/or invasion of privacy.
RESOLUTION OF DISPUTES
The validity, construction, and performance of these Official Rules, and resolution, award enforcement, and collection relating to any dispute or claim relating to the Contest, Festival, and/or these Official Rules shall be governed and construed in accordance with the laws of the State of California, without giving effect to any conflict of laws provisions. Any and all disputes and claims relating to the Contest shall be solely submitted for binding arbitration to ADR Services, Inc. in Los Angeles County, California under ADR Services’ arbitration rules. In the event that ADR Services no longer exists, Sponsor shall select another arbitration service in Los Angeles County to conduct the binding arbitration under such services’ rules. In the event of arbitration or litigation, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs related to such action, suit, or proceeding.
Each entrant and/or participant thus KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION IN CONNECTION WITH THE CONTEST, FESTIVAL, AND/OR THE OFFICIAL RULES. FURTHER, EACH ENTRANT AND/OR PARTICIPANT AGREES THAT HE/SHE MAY BRING CLAIMS AGAINST SPONSOR ONLY IN HIS/HER INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER OR IN ANY REPRESENTATIVE CAPACITY OR PROCEEDING.
Participation constitutes entrant’s full and unconditional agreement to and acceptance of these official rules (the “Official Rules”). For a copy of the Official Rules, please visit The Los Angeles Inner City Cultural Center website.
The Los Angeles Inner City Cultural Center’s “The Inner City Film Festival and Awards Show” contest (the “Contest”) is sponsored by The Los Angeles Inner City Cultural Center, a California nonprofit corporation. (the “Sponsor”).
Current employees or agents of the Sponsor and their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, providers, suppliers and the members of their immediate families or those persons living in the same household of such individuals are ineligible to enter or win the Contest. All international, federal, state, and local rules and regulations apply. The Contest is void in all countries, territories, and possessions where prohibited or restricted by law.
Sponsor administers and is solely responsible for all aspects of the Contest. Any questions, comments, or complaints regarding the Contest must be emailed to Sponsor (unless otherwise specified).
This contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter, Apple, or Google. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
