Inscrições – Cine Tornado Festival
O presente Regulamento estabelece as normas para inscrição e participação no Cine Tornado Festival, bem como as condições de autorização de exibição das obras selecionadas.
A inscrição implica aceitação integral e irretratável deste Regulamento e da Carta de Concordância.
1. DA PREMIAÇÃO
1.1. A premiação, de natureza simbólica ou eventualmente em espécie, quando possível, constitui reconhecimento artístico concedido pela curadoria, júri e/ou público ao melhor filme de cada categoria.
1.2. A honraria será entregue exclusivamente ao diretor da obra ou ao responsável legal pela inscrição, desde que comprovadamente detentor dos direitos de exibição da obra.
1.3. O festival não garante premiação em dinheiro, podendo a natureza do prêmio variar a cada edição.
2. DAS INSCRIÇÕES
2.1. As inscrições serão realizadas exclusivamente por meio da plataforma FilmFreeway: https://filmfreeway.com/CineTornadoFestival
2.2. O período de inscrições será de 4 de janeiro a 10 março de cada ano, com taxas reduzidas até 4 de fevereiro.
2.3. Cada responsável poderá inscrever:
• até 2 (duas) obras, se pessoa física;
• até 3 (três) obras, se pessoa jurídica.
2.4. Em categorias isentas de taxa de inscrição, será permitida apenas 1 (uma) obra por responsável.
2.5. Cada obra inscrita corresponde a uma taxa individual de inscrição, não reembolsável sob nenhuma hipótese.
3. DAS CATEGORIAS
As obras serão classificadas conforme sua duração:
• Curta-metragem: 1 a 15 minutos
• Média-metragem: 16 a 60 minutos
• Longa-metragem: 61 minutos ou mais
3.1. Obras cuja metragem real não corresponda à categoria inscrita poderão ser desclassificadas, sem direito à devolução da taxa.
3.2. A curadoria poderá reclassificar a categoria artística da obra, desde que respeitada sua metragem.
4. DOS REQUISITOS TÉCNICOS
4.1. As obras deverão estar disponíveis para download desde o momento da inscrição até o encerramento do período de exibição.
4.2. Especificações técnicas recomendadas:
• Resolução: preferencialmente 1920x1080 (Full HD)
• Codec: H.264
• Proporção: 16:9
• Bitrate: entre 10.000 e 20.000 kbps
• Áudio: preferencialmente 5.1; aceita-se estéreo 2.0
4.3. As legendas deverão ser enviadas em arquivo separado (.srt).
4.4. Filmes internacionais e nacionais deverão conter legendas em português (EN e BR).
5. DA DISPONIBILIDADE DA OBRA
5.1. A obra deverá permanecer acessível para download até:
• a definição da programação, se não selecionada;
• o término do período de autorização de exibição, se selecionada.
5.2. A indisponibilidade injustificada do arquivo poderá resultar na desclassificação da obra.
6. DA AUTORIZAÇÃO DE EXIBIÇÃO (CARTA DE CONCORDÂNCIA)
6.1. A inscrição implica concessão automática de autorização gratuita, não exclusiva e sem cessão de titularidade, para exibição pública da obra no âmbito do Cine Tornado Festival.
6.2. A autorização:
• é válida por 2 (dois) anos contados do encerramento das inscrições;
• limita-se ao máximo de 6 (seis) exibições presenciais;
• restringe-se a eventos oficiais vinculados ao festival;
• não inclui comercialização da obra;
• não inclui disponibilização online integral da obra, salvo em situações excepcionais de força maior, quando a organização poderá adaptar o formato de exibição, inclusive por meios digitais, exclusivamente no âmbito institucional do festival.
6.3. As exibições poderão ocorrer em cidades brasileiras ou em mostras presenciais internacionais vinculadas institucionalmente ao festival.
6.4. A organização é a única responsável pela definição da programação e ordem de exibição.
7. DIREITOS AUTORAIS E RESPONSABILIDADE
7.1. O responsável pela inscrição declara, sob sua exclusiva responsabilidade, que:
• detém todos os direitos autorais e conexos da obra;
• possui autorização para uso de trilha sonora, imagem, voz e quaisquer elementos de terceiros;
• está legalmente autorizado a conceder a autorização prevista neste regulamento.
7.2. O responsável compromete-se a indenizar e isentar o Cine Tornado Festival de qualquer reclamação, ação judicial, cobrança ou demanda decorrente de violação de direitos autorais, conexos ou de imagem.
7.3. O festival não se responsabiliza por eventuais pagamentos a entidades arrecadadoras (ECAD) sendo tais encargos de responsabilidade exclusiva do titular da obra.
7.4. O Cine Tornado Festival não se responsabiliza por falhas técnicas da plataforma de inscrição, indisponibilidade de servidores, perda de arquivos por causas alheias à sua vontade ou quaisquer danos indiretos decorrentes da participação no evento.
8. USO DE IMAGEM E MATERIAL PROMOCIONAL
8.1. O responsável autoriza o uso gratuito de:
• trechos da obra (até 3 minutos),
• trailer,
• fotos,
• cartaz,
• stills,
• imagens pessoais do diretor/produtor,
exclusivamente para fins de divulgação institucional do festival, em meios físicos, digitais e redes sociais.
8.2. A utilização será sempre vinculada à divulgação do evento.
9. TAXAS E POLÍTICA DE NÃO REEMBOLSO
9.1. As taxas de inscrição não serão devolvidas em nenhuma hipótese, inclusive em caso de:
• desclassificação;
• não seleção;
• erro de categoria;
• cancelamento do evento por força maior.
10. CANCELAMENTO E FORÇA MAIOR
10.1. O festival poderá ser adiado, suspenso, adaptado ou cancelado por motivo de força maior, incluindo, mas não se limitando a, pandemias, guerras, desastres naturais, atos governamentais, restrições legais, falhas sistêmicas ou quaisquer circunstâncias imprevisíveis e alheias à vontade da organização.
10.2. Nessas hipóteses, não haverá obrigação de indenização ou reembolso.
11. COMUNICAÇÃO OFICIAL
11.1. Todas as informações oficiais serão divulgadas no site e redes sociais oficiais do festival: https://www.cinetornadofestival.com.br/ e @cinetornadofestival
11.2. Recomenda-se que os selecionados colaborem com a divulgação institucional do evento, sempre que possível seguindo o perfil do evento nas redes sociais.
12. DISPOSIÇÕES GERAIS
12.1. Casos omissos serão resolvidos pela organização do festival.
12.2. A decisão da curadoria é soberana e irrecorrível.
12.3. A inscrição implica concordância integral com este Regulamento.
13. DO FORO
13.1. Fica eleito o foro da Comarca de São Paulo/SP, com renúncia expressa a qualquer outro, por mais privilegiado que seja, para dirimir eventuais controvérsias decorrentes deste Regulamento, ou de qualquer outro assunto referente aos eventos do Cine Tornado Festival.
13.2. Participantes estrangeiros renunciam expressamente a qualquer foro diverso do aqui eleito, inclusive com base em legislações de proteção ao consumidor ou normas internacionais que pretendam deslocar a competência jurisdicional.

Cine Tornado Festival
Submissions
These Regulations establish the rules governing submission to and participation in the Cine Tornado Festival, as well as the conditions for the exhibition authorisation of selected works.
Submission of a film constitutes full, irrevocable and unconditional acceptance of these Regulations and of the Agreement Letter.
1. AWARDS
1.1. The awards, whether symbolic or monetary where applicable, constitute artistic recognition granted by the curatorial board, jury and/or audience to the best film in each category.
1.2. Any honour or award shall be presented exclusively to the director of the work or to the legal representative responsible for the submission, provided that such person demonstrably holds the exhibition rights to the work.
1.3. The Festival does not guarantee monetary prizes, and the nature of the awards may vary from edition to edition.
2. SUBMISSIONS
2.1. Submissions shall be made exclusively via the FilmFreeway platform.
2.2. The submission period shall be announced annually on the Festival’s official website.
2.3. Each submitter may enter:
• up to two (2) works as an individual (natural person);
• up to three (3) works as a legal entity.
2.4. In categories exempt from submission fees, only one (1) work per submitter shall be permitted.
2.5. Each submitted work is subject to an individual entry fee, which is non-refundable under any circumstances.
3. CATEGORIES
Works shall be classified according to their running time:
• Short Film: 1 to 15 minutes
• Mid-length Film: 16 to 60 minutes
• Feature Film: 61 minutes or more
3.1. Works whose actual running time does not correspond to the category entered may be disqualified without refund.
3.2. The curatorial board reserves the right to reclassify the artistic category of a work, provided that its running time is respected.
4. TECHNICAL REQUIREMENTS
4.1. Submitted works must remain available for download from the time of submission until the conclusion of the authorised exhibition period.
4.2. Recommended technical specifications:
• Resolution: preferably 1920x1080 (Full HD)
• Codec: H.264
• Aspect ratio: 16:9
• Bitrate: between 10,000 and 20,000 kbps
• Audio: preferably 5.1; stereo 2.0 is acceptable
4.3. Subtitles must be provided in a separate .srt file.
4.4. International films must include Portuguese (BR) subtitles.
Films in Portuguese must include English (EN) subtitles.
5. AVAILABILITY OF THE WORK
5.1. The submitted work must remain accessible for download until:
• the programme has been finalised, if the work is not selected; or
• the end of the authorised exhibition period, if selected.
5.2. Unjustified unavailability of the file may result in disqualification.
6. EXHIBITION AUTHORISATION (AGREEMENT LETTER)
6.1. Submission of a work automatically grants the Festival a non-exclusive, royalty-free authorisation, without transfer of ownership, to publicly exhibit the work within the scope of the Cine Tornado Festival.
6.2. Such authorisation:
• shall remain valid for two (2) years from the closing date of submissions;
• shall be limited to a maximum of six (6) in-person screenings;
• shall apply exclusively to official events linked to the Festival;
• shall not include commercial exploitation of the work;
• shall not include full online streaming or digital distribution, except in exceptional circumstances of force majeure, in which case the organisation may adapt the exhibition format, including digital means, strictly within the institutional scope of the Festival.
6.3. Screenings may take place in Brazilian cities or at international in-person showcases institutionally affiliated with the Festival.
6.4. The Festival organisation shall have sole discretion over programming decisions and screening order.
7. COPYRIGHT AND LIABILITY
7.1. The submitter declares, under their sole responsibility, that:
• they hold all copyright and related rights to the work;
• they possess all necessary permissions for the use of soundtrack, image, voice and any third-party elements;
• they are legally authorised to grant the authorisation set out in these Regulations.
7.2. The submitter agrees to indemnify and hold harmless the Cine Tornado Festival against any claim, legal action, charge or demand arising from infringement of copyright, related rights or image rights.
7.3. The Festival shall not be responsible for any payments to collecting societies or rights management organisations, such responsibility resting solely with the rights holder.
7.4. The Festival shall not be liable for technical failures of the submission platform, server unavailability, file loss due to circumstances beyond its control, or any indirect damages arising from participation in the event.
8. USE OF IMAGE AND PROMOTIONAL MATERIAL
8.1. The submitter authorises the free use of:
• excerpts of the work (up to three minutes);
• trailer;
• photographs;
• poster artwork;
• stills;
• images of the director/producer;
strictly for institutional promotional purposes of the Festival, in print and digital media and on social networks.
8.2. Such use shall always be linked to the promotion of the Festival.
9. FEES AND NON-REFUND POLICY
9.1. Submission fees shall not be refunded under any circumstances, including but not limited to:
• disqualification;
• non-selection;
• incorrect category entry;
• cancellation of the event due to force majeure.
10. CANCELLATION AND FORCE MAJEURE
10.1. The Festival may be postponed, suspended, adapted or cancelled due to force majeure, including but not limited to pandemics, war, natural disasters, governmental acts, legal restrictions, systemic failures or any unforeseen circumstances beyond the control of the organisation.
10.2. In such cases, no compensation or reimbursement shall be due.
11. OFFICIAL COMMUNICATION
11.1. All official information shall be published on the Festival’s website and official social media channels.
11.2. Selected participants are encouraged to collaborate in the institutional promotion of the event.
12. GENERAL PROVISIONS
12.1. Any matters not provided for herein shall be resolved by the Festival organisation.
12.2. Decisions of the curatorial board are final and not subject to appeal.
12.3. Submission constitutes full acceptance of these Regulations.
13. JURISDICTION
13.1. Any disputes arising from these Regulations shall be governed by Brazilian law and submitted to the Courts of São Paulo/SP, Brazil, with express waiver of any other jurisdiction, however privileged.
13.2. Foreign participants expressly waive any claim to jurisdiction outside Brazil, including claims based on consumer protection laws or international jurisdiction rules that might attempt to transfer competence to another country.

cARTA DE CONCORDÂNCIA
Cine Tornado Festival
Eu, ________________________________________________, portador(a) do CPF/CNPJ ou documento de identificação nº ____________________________, na qualidade de diretor(a), produtor(a), distribuidor(a) ou responsável legal pela inscrição da obra audiovisual intitulada ________________________________________________, declaro, para todos os fins de direito, que detenho a titularidade ou estou devidamente autorizado(a) a representar todos os direitos autorais e conexos necessários à exibição pública da referida obra. Declaro que a obra não viola direitos de terceiros, incluindo, mas não se limitando, a direitos autorais, direitos de imagem, voz, trilha sonora ou quaisquer outros direitos de propriedade intelectual, assumindo integral responsabilidade por eventuais reivindicações judiciais ou extrajudiciais, comprometendo-me a isentar e indenizar o Cine Tornado Festival por quaisquer demandas decorrentes da exibição da obra.
Por meio da presente, autorizo, de forma gratuita, não exclusiva e sem cessão de titularidade, a exibição pública da obra no âmbito do Cine Tornado Festival, pelo prazo de 2 (dois) anos contados do encerramento das inscrições da respectiva edição, limitada ao máximo de 6 (seis) exibições presenciais, em território nacional ou em mostras presenciais internacionais oficialmente vinculadas ao festival. Esta autorização não inclui a comercialização da obra nem sua disponibilização online integral, restringindo-se exclusivamente às atividades institucionais do evento. Autorizo igualmente a utilização gratuita de trechos da obra, limitados a até 3 (três) minutos, bem como trailer, fotografias, cartaz, stills e imagens do(a) diretor(a) ou produtor(a), exclusivamente para fins de divulgação institucional do festival em mídias impressas, digitais e redes sociais.
Declaro que li integralmente o Regulamento do Cine Tornado Festival e que concordo plena, irrevogável e integralmente com todos os seus termos e condições.

AGREEMENT LETTER – Exhibition Authorization
Cine Tornado Festival
I, ________________________________________________, holder of ID/Passport/Company Registration No. ____________________________, acting as director, producer, distributor, or legal representative of the audiovisual work entitled ________________________________________________, hereby declare that I hold or am duly authorized to represent all copyrights and related rights necessary for the public exhibition of the above-mentioned work. I further declare that the work does not infringe upon any third-party rights, including but not limited to copyright, image rights, voice rights, soundtrack rights, or any other intellectual property rights, and I assume full legal responsibility for any judicial or extrajudicial claims, agreeing to indemnify and hold harmless the Cine Tornado Festival from any liability arising from the exhibition of the work.
Through this Agreement Letter, I grant a non-exclusive, royalty-free authorization, without transfer of ownership, for the public exhibition of the work within the scope of the Cine Tornado Festival for a period of two (2) years from the closing date of submissions of the respective edition, limited to a maximum of six (6) in-person screenings in Brazil or in officially affiliated international in-person showcases. This authorization does not include commercial exploitation of the work nor full online distribution, being strictly limited to institutional festival activities. I also authorize the free use of excerpts of the film (up to three minutes), trailer, stills, poster artwork, and images of the director/producer strictly for promotional and institutional purposes related to the festival in print and digital media.
I confirm that I have fully read and understood the official Rules & Regulations of the Cine Tornado Festival and agree to them entirely and irrevocably.
The Courts of São Paulo/SP, Brazil, shall have exclusive jurisdiction over any disputes arising from this agreement.
