ENG - The Cactus Film Festival is about great films and filmmakers who inspire, surprise, delight and challenge audiences of all ages. Filmmakers can expert curation, personal attention and respect for their art, along with a genuine desire to promote, as the Cactus mission states, a more intelligent and diverse film culture for children and young people audiences.
One of the objectives of the Cactus Film Festival is to offer children and young people quality cinema made especially for them. Cactus chooses stories that dialogue with their lives and interests and that, at times, become tools or pretexts for deeper and broader reflection: just what happens every time we grow up a little.

ENG - REGULATIONS

The fourth edition of the Cactus International Children's and Youth Film Festival (the “CIFF”), a festival dedicated to high quality fiction and nonfiction films, in every genre, dedicated to children, kids and young people, will take place in Aosta, Italy, from 2 to 12 May 2024 and it is organized by Long Neck Doc ETS (www.cactusfilmfestival.com).

Please, read the following terms and conditions (the “Terms”) for participating to The CIFF 2024 (the “Festival”).

By submitting the Short Film (the “Film”), the participant expressly acknowledges and agrees that he/she/it shall be bound by the terms of this agreement.

This list of regulations has been drawn up in both the Italian and English languages. If problems of interpretation should arise the version in Italian will prevail.
The management of the CIFF is allowed to take decisions that are not foreseen in the above regulations and to change the regulations in special cases.
The Court of Aosta (Italy) is regarded as the competent authority for all eventual controversy.

FESTIVAL REGISTRATION
Each participant (the “Participant”) may submit only one film, registering for the CIFF2024 through the FilmFreeway platform at the link https://filmfreeway.com/cactusfilmfestival.
Registration (the “Entry”) consists in sending the Film, materials and data mentioned in these Terms and in the above FilmFreeway platform.
The submission of the Film must take place by 31/10/2023, the closing date for entries.
The short films must have a maximum duration of 25'.
By submitting a Film to the CIFF for Festival consideration, the submitter (the “Applicant”) represents that he, she or it has obtained consent from any and all the Film Owners for submitting the Short Film to the CIFF and screening the Film and at associated projects, such as Cactus Edu and Cactus Lab, in theaters or online, and has read, understood and agreed to these Terms.
The CIFF may disqualify or reject any Entry that it determines, in its sole and absolute discretion, is not in compliance, in whole or in part, with these Terms or with what is requested by the registration platform, and may do so without returning the Applicant’s submission, where applicable.
To be eligible to screen in the CIFF 2024, production of the Film must be completed no earlier than January 1, 2021.
If the Film contains dialogue, voice over or any narration not in English or Italian or French, the Entry must be subtitled or dubbed in English or Italian or French.
Once submitted, Entries may not be withdrawn from participation in the Festival, except for serious and documented reasons which must in any case be examined by the CIFF management.

SELECTION
The selection of the Films admitted to the Festival will take place by 01/12/2023, the date on which the selected Films will be communicated.
In the event of selection, the Applicant must deliver to the CIFF an HD digital video file of the Film by electronic file transfer. Further information will be provided by the organization committee.
The Applicant must submit available promotional materials of the Film such as high-resolution stills, production credits, director’s biography and press reviews, which will be used by the CIFF for the presentation of the Film within the Festival and events and related initiatives.

INTELLECTUAL PROPERTY - GRANT OF RIGHTS
By submitting the Film to the CIFF, the Applicant and Film Owners (the “Submitting Parties”) hereby represent and warrant that:
(a) the Film is wholly original and is not copied from and does not include any other work that is the subject of copyright or other protection, unless such work is in the public domain or the Submitting Parties have obtained any and all consents, releases, licenses and other authorizations or waivers of any kind necessary for the inclusion or reproduction of any person, character, location, thing, trademark, sound recording, musical composition or other work in the Entry;
(b) the Film does not defame any person or violate the common law or statutory rights;
(c) there are no agreements, nor will there be any agreements made subsequent to the date of the submission of the Film that would or could have the effect of impairing the Submitting Parties’ ability to provide the Film as contemplated herein, or otherwise conflict with any provision of these Terms;
(d) the Applicant agrees to indemnify and hold harmless the CIFF, its licensees, successors and assigns and its and their members, collaborators and affiliates (each a “Releasee”), from any claim, suit, action or other proceeding deriving from the use and exhibition of the Film submitted by the Applicant in the CIFF, or the breach or alleged breach of any representation, warranty or other agreement or concession set forth in these Terms.

If the Applicant’s Film is selected for participation in the Festival, the Applicant hereby irrevocably grants the CIFF the following rights with respect to the Film on a “free-use” no-fee basis, without reservations, conditions or qualifications:
(a) the right to exhibit the Film to the Festival juries, both with on-site screenings and through shared links on a secure streaming platform;
(b) the right to screen the Film during the Festival, including through a secure streaming platform;
(c) the right to present or allow others to present excerpts of the Film up to a total of three minutes in length in any medium (national, international and also via the web) for promotional purposes;
(d) the right to incorporate and use stills, art, footage, biographical material, names and likenesses from the Film for promotional purposes and for any purpose connected with the Festival and its collateral events and initiatives;
(e) the right to share with press and media the trailer of the Film, provided at the time of registration, for promotional purposes;
(f) the right to exhibit the Film for educational use for a period of nine months following the Festival, also through a secure streaming platform, without territorial limits, as part of the Cactus Edu and Cactus Lab initiatives;
(g) the right to make the Film available for public exhibition at Italian venues nationally for a period of nine months following the Festival as part of the touring Festival programs;
(h) the right to retain any and all revenues from merchandise and sponsorship associated with the Film’s participation in the Festival or any associated events;
(i) the right to keep a copy of the winning Films, on digital support in high definition, which will be kept in the historical archive of the CIFF and intended for the exclusive purposes of study, conservation and projection in any future retrospectives.

The CIFF shall use its best efforts to ensure correct title and credits are listed on Festival materials but shall not be held liable for inadvertent errors and omissions.

The CIFF reserves the right, in its sole and absolute discretion, to schedule or adjust dates and times of all film screenings at the Festival or any associated events and to shift the presentation of the Festival from theaters to an online experience. Participation in the CIFF implies the acceptance of presenting the selected Films also online through a secure streaming platform with exclusive access for participants in the Cactus Edu and Cactus Lab projects.

ITA - REGOLAMENTO

La quarta edizione del Cactus International Children’s and Youth Film Festival (“CIFF”), festival dedicato ai cortometraggi di alta qualità, fiction e non fiction, di qualunque genere, dedicati al pubblico dall’infanzia sino ai giovani adulti, si svolgerà ad Aosta, Italia, dal 2 al 12 maggio 2024 ed è organizzata Long Neck Doc ETS (www.cactusfilmfestival.com).

Si prega di leggere i seguenti termini e condizioni (i “Termini”), che regolano la partecipazione delle opere per il CIFF 2024 (il “Festival”).

Inviando il cortometraggio (l’“Opera”), il Partecipante riconosce ed accetta espressamente di essere vincolato dai Termini del presente regolamento.

Il presente regolamento è stato redatto sia in lingua italiana sia in lingua inglese. In caso di divergenze prevarrà la versione in italiano.
La direzione del CIFF è autorizzata a prendere decisioni che non sono contemplate nel presente regolamento ed agire in deroga ad esso in casi particolari, riservandosi altresì di decidere su tutte le questioni non specificatamente previste.
Autorità competente per ogni eventuale controversia è il Tribunale di Aosta (Italia).

SEZIONI UFFICIALI, GIURIE E PREMI DEL CIFF 2024
- Premio "Giuria Scuola”, uno per ogni sezione competitiva (3+, 8+, 11+ e 15+), la cui giuria sarà composta dagli studenti delle scuole italiane che aderiranno al progetto Cactus Edu.
- Premio "Giuria Tecnica”, uno per ogni sezione competitiva (3+, 8+, 11+ e 15+), la cui giuria sarà composta da esperti del settore educativo e cinematografico.
- ECFA Short Film Award per il Miglior Cortometraggio Europeo (www.ecfaweb.org).
- Premio del Pubblico, uno per ogni sezione competitiva (3+, 8+, 11+ e 15+), la cui giuria sarà composta dagli spettatori che vedranno le opere proiettate in sala durante lo svolgimento del Festival.

ISCRIZIONE AL FESTIVAL
Ogni partecipante (il “Partecipante”) può partecipare con una sola Opera, iscrivendosi al Festival per il tramite della piattaforma FilmFreeway al link https://filmfreeway.com/cactusfilmfestival (l’”Iscrizione”).
L’Iscrizione consiste nell’invio dell’Opera, del materiale e dei dati richiesti dalla suddetta piattaforma e dai presenti Termini.
L’invio dell’Opera dovrà avvenire entro il 31/10/2023, data di chiusura delle iscrizioni.
I cortometraggi devono avere una durata massima di 25'.
Con l’Iscrizione di un’Opera al Festival, il Partecipante dichiara di aver ottenuto il consenso da tutti i titolari di qualsivoglia diritto sull’Opera, ed in particolare il consenso specifico per poter presentare la domanda di iscrizione al Festival, per la proiezione dell’Opera al Festival ed agli eventi ed iniziative ad esso associati, quali Cactus Edu e Cactus Lab, nelle sale fisiche o virtuali, e di aver letto, compreso ed accettato i presenti Termini.
Il CIFF, a sua esclusiva e assoluta discrezione, può rifiutare ogni Iscrizione che sia ritenuta non conforme, in tutto o in parte, ai presenti Termini od a quanto richiesto dalla piattaforma di iscrizione, senza che ciò implichi la restituzione della quota di iscrizione al Partecipante, ove prevista.
Affinché l’Opera sia ammessa al CIFF 2024 la sua produzione deve essere conclusa non prima del 1° gennaio 2021.
Se l’Opera contiene dialoghi o voice over o qualunque altra narrazione verbale in una lingua diversa dall’italiano, dall’inglese o dal francese, la stessa deve essere doppiata o sottotitolata in italiano, inglese o francese.
Una volta inviata, l’Iscrizione non potrà essere ritirata, se non per gravi e documentati motivi che dovranno comunque essere vagliati dalla direzione del CIFF.

SELEZIONE
La selezione delle opere ammesse al Festival avverrà entro il 01/12/2023, data nella quale verranno comunicate le opere selezionate.
In caso di selezione, il Partecipante si impegna a consegnare al CIFF un file video digitale HD dell’Opera mediante trasferimento di file elettronico, come da indicazioni che saranno successivamente fornite dall’organizzazione del Festival.
Il Partecipante dovrà altresì inviare il materiale promozionale relativo all’Opera, come foto ad alta risoluzione, crediti di produzione, biografia del regista ed eventuali rassegne stampa, che saranno utilizzate dal CIFF per la presentazione dell’Opera nell’ambito del Festival e degli eventi ed iniziative ad esso collegati.

PROPRIETÀ INTELLETTUALE E CONCESSIONE DI DIRITTI
Con l’Iscrizione al CIFF, il Partecipante e, per il tramite di esso, tutti i titolari dell’Opera dichiarano e garantiscono che:
(a) l’Opera è originale, non è copiata né contiene altro materiale soggetto a copyright o altra tutela, ed il Partecipante ha ottenuto tutti i consensi, le liberatorie, le licenze e le autorizzazioni o rinunce di qualsivoglia tipo necessari per l’inclusione o la riproduzione di qualsiasi persona, personaggio, luogo, oggetto, marchio, immagini, fotografie, registrazione sonora, composizione musicale o altro materiale all’interno dell’Opera;
(b) l’Opera non diffama alcuna persona né viola qualsivoglia diritto di terzi;
(c) non ci sono accordi e non ne saranno presi successivamente alla data di presentazione dell’Iscrizione che pregiudichino o potrebbero pregiudicare la capacità del Partecipante di fornire l’Opera come contemplato nel presente regolamento, o comunque altrimenti in conflitto con qualsiasi disposizione dei presenti Termini;
(d) il Partecipante accetta di manlevare il CIFF, i suoi licenziatari, successori e aventi causa, loro membri, collaboratori e affiliati, da qualsiasi reclamo, causa, azione legale o altro procedimento derivante dall’uso e dalla proiezione dell’Opera presentata dal Partecipante al CIFF, o dalla violazione o presunta violazione di qualsiasi dichiarazione, garanzia o altro impegno o concessione di cui ai presenti Termini.

Il Partecipante, qualora l’Opera fosse selezionata per la partecipazione al Festival, concede al CIFF senza riserve né condizioni, a titolo gratuito e senza corrispettivo alcuno, i seguenti diritti sull’Opera selezionata:
(a) il diritto di rendere disponibile l’Opera alle giurie del Festival, sia con proiezioni in loco che attraverso link condivisi per il tramite di una piattaforma streaming sicura;
(b) il diritto di proiettare l’Opera durante il Festival, anche attraverso una piattaforma di streaming sicura;
(c) il diritto di mostrare e trasmettere o di consentire a terzi di mostrare e trasmettere estratti dell’Opera su qualunque mezzo e/o canale (nazionale ed internazionale, ed anche via web), fino a un totale di tre minuti di durata, per scopi promozionali;
(d) il diritto di includere e utilizzare fotogrammi, grafiche, filmati, materiale biografico, nomi e materiali affini provenienti dall’Opera per scopi promozionali e per ogni finalità connessa al Festival ed ai suoi eventi ed iniziative collaterali;
(e) il diritto di condividere con la stampa e i media il trailer dell’Opera fornita al momento dell’iscrizione per scopi promozionali;
(f) il diritto di proiettare l’Opera a scopo educativo e/o promozionale nell’arco dei nove mesi successivi al Festival, anche attraverso una piattaforma di streaming sicura, senza limiti territoriali, nell’ambito delle iniziative del Cactus Edu e Cactus Lab;
(g) il diritto di rendere disponibile l’Opera nell’arco dei nove mesi successivi al Festival, esclusivamente sul territorio italiano, nell’ambito del programma itinerante del Festival;
(h) il diritto di trattenere tutte le entrate derivanti da merchandising e sponsorizzazioni legate alla partecipazione dell’Opera al Festival o a qualsiasi evento ed iniziativa collaterale;
(i) il diritto di conservare una copia delle opere vincitrici, su supporto digitale in alta definizione, che sarà conservata nell’archivio storico del CIFF e destinata ad esclusivi fini di studio, di conservazione e di proiezione in eventuali future retrospettive.

Il CIFF farà del suo meglio per garantire che i materiali del Festival contengano titolo e crediti corretti, ma non sarà ritenuto responsabile per errori e omissioni involontarie.

Il CIFF si riserva il diritto, a sua esclusiva e assoluta discrezione, di programmare o modificare le date e gli orari di tutte le proiezioni del Festival o di qualsiasi evento associato, e di organizzare il Festival sia nelle sale fisiche che online. La partecipazione al CIFF implica l’accettazione di presentare l’Opera selezionata anche online attraverso una piattaforma di streaming sicura ad accesso esclusivo dei partecipanti ai progetti Cactus Edu e Cactus Lab.
