1. Eligibility
All submitted films must be shorter than ten (10) minutes in total runtime, including credits. Applicants must be eighteen (18) years of age or older. Students may submit, but there is no separate student category.
2. Submission Process
All submissions must be made through FilmFreeway. Submission of a film does not guarantee acceptance, selection, screening, or any other participation in the Festival. The Festival reserves the right to reject any submission at any time, for any reason permitted by law, in the sole and absolute discretion of the Festival.
3. Fees
All submission fees are used to support theater rental and administrative costs associated with the Festival. All submission fees are non-refundable under any circumstances, including, without limitation, rejection, non-selection, technical issues, withdrawal, or cancellation of the Festival.
4. Screening Format and Delivery
The accepted submission and screening format is MP4 only. Applicants are solely responsible for ensuring that all submitted and final screening files are correctly formatted, complete, and playable. Final screening files must be delivered no later than fourteen (14) days prior to the scheduled screening date. The Festival is not responsible for technical issues arising from improperly formatted, incomplete, damaged, or unplayable files submitted by the Applicant.
5. Rights Granted to the Festival
By submitting a film, the Applicant grants the Festival a perpetual, non-exclusive, royalty-free, worldwide right to exhibit the submitted film in person at the Festival’s theater screening venue and to use the film, or any portion thereof, together with the film’s title, logline, synopsis, stills, trailer, poster, creator names, and other submitted materials, for Festival-related promotion, publicity, documentation, archival use, and future promotional materials in any media now known or later developed, including without limitation social media, websites, press materials, printed materials, and electronic communications.
6. Ownership
All submitted films remain the sole property of their creators and/or rights holders. Nothing in these Terms and Conditions shall be construed as transferring ownership, copyright, distribution rights, or any other proprietary interest in the film to the Festival.
7. Rights Clearance and Liability
The Applicant represents and warrants that the Applicant has secured all rights, licenses, permissions, clearances, releases, and consents necessary for submission, in-person exhibition, and Festival promotional use of the film and all elements contained therein, including without limitation music, images, footage, performances, names, likenesses, trademarks, and other copyrighted or protected material. All liability relating to copyright infringement, unauthorized use, or any other rights violation shall rest solely with the Applicant.
8. Content Restrictions
The Festival will not accept films containing illegal content, hate speech, racist content, sexist content, prejudiced content, or pornography. The Festival reserves the right to determine, in its sole discretion, whether any submission violates this policy.
9. Curatorial Discretion
The Festival retains full and final curatorial discretion over all programming decisions, including selection, scheduling, placement, screening order, and presentation. The Festival may edit, alter, reorganize, or remove films from the program as necessary to address technical issues, scheduling conflicts, venue limitations, or other operational concerns.
10. Waivers
Fee waivers may be requested by email to the Festival organizers and may be granted or denied at the Festival’s sole discretion.
11. Official Selection
The Applicant may publicly announce that a film has been selected as an official selection only after receiving confirmation from the Festival. The Applicant shall not imply Festival approval or selection before receiving such confirmation.
12. Communications
Official communications regarding the Festival and submissions will be conducted through FilmFreeway and any email address designated by the Festival organizers. The Festival is not responsible for communications sent through unofficial channels.
13. Liability Limitation
To the fullest extent permitted by applicable law, the Festival, its organizers, venue, staff, volunteers, affiliates, representatives, and agents shall not be liable for any claim, loss, damage, cost, or expense arising from or related to submission, non-selection, rejection, technical errors, scheduling changes, promotional use authorized under these Terms and Conditions, or the Applicant’s failure to comply with these Terms and Conditions.
14. Indemnification
To the fullest extent permitted by law, the Applicant agrees to defend, indemnify, and hold harmless the Festival, its organizers, venue, staff, volunteers, affiliates, representatives, and agents from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to the Applicant’s submission, the content of the film, the Applicant’s breach of these Terms and Conditions, or any claim that the Festival’s authorized use of the film or submitted materials infringes, misappropriates, or otherwise violates any third-party rights.
15. Standard Liability
The Festival shall use reasonable efforts to present accepted films in accordance with its programming and technical standards. However, the Festival makes no guarantee that any film will be screened exactly as intended beyond commercially reasonable exhibition practices and available venue conditions.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
17. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, void, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. Any invalid or unenforceable provision shall be modified only to the minimum extent necessary to make it enforceable, if possible.
18. Acceptance of Terms
Submission of a film through FilmFreeway constitutes the Applicant’s full and binding acceptance of these Terms and Conditions.
The Festival reserves the right to amend these Terms and Conditions at any time, with any changes applying prospectively to future submissions.
