Terms & Conditions – Surf Film Festival Hamburg

Eligibility
-The film must be related to surfing (such as windsurfing, wave surfing, kitesurfing, etc.).
-Length: Short Film: up to 15 minutes; Feature Film: from 15 minutes.
-Completion Date: from April 2024.
-English subtitles are required.
The film must not be freely available online. Premieres are welcome but not mandatory. The film must not screen at another festival in German-speaking countries (D-A-CH) during April 2026.
The applicant must own all rights to the film and its associated materials (especially music and audiovisual content) necessary for the presentation and promotion of the film within the festival context. See section Rights & Usage for details.
If selected: The following materials must be made available for download no later than three weeks before the festival:
Film file in Apple ProRes 422 HQ, 10 bit, 24 fps, 5.1 audio mix
Promotional materials: trailer, 3–5 stills, logline, short synopsis, Instagram handles
Attendance & Communication: Attendance by at least one member of the film team is encouraged. It is also requested that a post be made on Instagram announcing that the film is part of the Official Selection (tagging the festival).
1. Submission & Selection
Submission deadline: March 1, 2026. Incomplete submissions cannot be considered. Applicants will be notified of the selection results by early April 2026 via e-mail. All decisions made by the festival management are final and binding. Selected films may be screened multiple times during the festival week; in case of technical issues, the submitted preview copy may be used. No screening fees will be paid for festival screenings.
2. Rights & Usage
By submitting a film, the applicant grants the Surf Film Festival Hamburg a non-exclusive, worldwide and perpetual right to:
publicly screen the film during the festival (including repeat screenings within the festival week),
use excerpts, stills, trailers and related materials solely for the purpose of promoting and reporting on the festival – across all media, including social media, website, press, television, print and online platforms,
and provide password-protected access to accredited press or industry representatives for editorial purposes.
The festival is entitled to delegate the granted rights to third parties (e.g., media partners, sponsors or PR agencies) for the purpose of festival organization and communication. The festival may retain a non-public archival copy for internal documentation. Commercial use of the film outside the festival context is excluded.
3. Rights Warranty & Indemnification
The applicant warrants and represents that they are entitled to grant the rights set out in Section “Rights & Usage” and that:
all necessary rights to picture, sound, music and text are duly cleared,
all rights holders and depicted persons have given valid consent,
and the festival’s use of the film does not infringe the rights of any third party.
The applicant shall indemnify and hold harmless the Surf Film Festival Hamburg, its organizers, partners, media partners, sponsors, representatives and employees from and against any and all third-party claims arising from or in connection with the screening, use or public presentation of the film or the submitted materials. This indemnification includes, in particular, claims for injunctions, damages, cease-and-desist letters, license or royalty payments, and the costs of reasonable legal defense (including attorney and court fees).
4. Liability & Data Protection
File transfers are made at the applicant’s own risk. The festival is liable only for intent or gross negligence, or in cases of injury to life, body or health. In all other cases, liability is limited to foreseeable and typical damages.
Personal data provided during the submission process will be processed solely for the organization and execution of the festival (Art. 6 para. 1 lit. b GDPR). Further information on data protection and the rights of data subjects under Articles 15 et seq. GDPR can be found in the festival’s privacy policy. By submitting a film, the applicant agrees to this data processing.
5. Final Provisions
The Surf Film Festival Hamburg reserves the right to make decisions in cases not covered by these terms. Submission of a film implies acceptance of these terms and conditions. The governing law is German law. In case of doubt or conflict, the German version of these Terms & Conditions shall prevail.
Teilnahmebedingungen – Surf Film Festival Hamburg
Voraussetzungen
-In dem Film muss es um das Surfen gehen (Windsurfen, Wellenreiten, Kitesurfen etc.).
-Länge: Kategorie Kurzfilm: bis 15 Minuten; Kategorie Langfilm: ab 15 Minuten.
-Fertigstellungsdatum: ab April 2024.
-Englische Untertitel sind erforderlich.
Der Film darf nicht frei im Internet verfügbar sein. Premieren sind erwünscht, aber kein Muss. Der Film darf im April 2026 nicht parallel auf einem anderen Festival im deutschsprachigen Raum laufen.
Der/die Einreichende muss alle Rechte am Film und den zugehörigen Materialien (insbesondere an der Musik und den verwendeten Bildern/Tönen) besitzen, die für die Nutzung und Vorführung im Rahmen des Festivals und der Berichterstattung über das Festival erforderlich sind. Einzelheiten hierzu siehe Abschnitt Rechte & Nutzung.
Bei erfolgreicher Auswahl müssen spätestens drei Wochen vor Festivalbeginn folgende Materialien zum Download bereitgestellt werden:

Werbematerialien: Trailer, 3–5 Stills, Logline, kurze Synopsis, Instagram-Handles
Anwesenheit & Kommunikation: Eine Anwesenheit von jemandem aus dem Filmteam ist erwünscht. Außerdem sollte auf Instagram gepostet werden, dass der Film Teil der Official Selection ist (mit Vertaggung des Festivals).
1. Einreichung & Auswahl
Einreichfrist: bis 1. März 2026. Unvollständige Einreichungen können nicht berücksichtigt werden. Die Auswahl wird bis Anfang April 2026 per E-Mail mitgeteilt. Entscheidungen der Festivalleitung sind endgültig und nicht anfechtbar. Ausgewählte Filme können während der Festivalwoche mehrfach gezeigt werden; bei technischen Problemen darf auf die eingereichte Sichtungskopie zurückgegriffen werden. Für Vorführungen werden keine Screening Fees gezahlt.
2. Rechte & Nutzung
Mit der Einreichung räumt der/die Einreichende dem Surf Film Festival Hamburg ein einfaches, zeitlich und räumlich unbeschränktes Recht ein, den Film:
im Rahmen des Festivals öffentlich vorzuführen (einschließlich Wiederholungen während der Festivalwoche),
Ausschnitte, Stills, Trailer und sonstiges Filmmaterial ausschließlich zur Festivalbewerbung und Berichterstattung zu nutzen – in allen Medien, insbesondere auf Social Media, Website, Presse, TV, Print und Online-Plattformen,
sowie zum Zweck der Pressearbeit passwortgeschützte Ansichten für akkreditierte Medien oder Branchenvertreter bereitzustellen.
Das Festival ist berechtigt, diese Nutzungsrechte auch durch Dritte (z. B. Medienpartner, Sponsoren oder PR-Dienstleister) im Rahmen der Festivalorganisation und -kommunikation ausüben zu lassen. Das Festival darf außerdem eine nicht-öffentliche Archivkopie für interne Dokumentationszwecke speichern. Eine kommerzielle Nutzung des Films außerhalb des Festival-Kontexts ist ausgeschlossen.
3. Rechtegarantie & Freistellung
Der/die Einreichende sichert rechtsverbindlich zu, dass er/sie berechtigt ist, die in Abschnitt „Rechte & Nutzung“ genannten Rechte einzuräumen, und dass:
alle für die Nutzung erforderlichen Rechte an Bild, Ton, Musik und Text vorliegen,
alle Rechteinhaber:innen und abgebildeten Personen wirksam eingewilligt haben,
und die Nutzung durch das Festival keine Rechte Dritter verletzt.
Der/die Einreichende stellt das Surf Film Festival Hamburg sowie dessen Veranstalter, Partner, Medienpartner, Sponsoren, Beauftragte und Mitarbeiter:innen von sämtlichen Ansprüchen Dritter frei, die im Zusammenhang mit der Vorführung, Nutzung oder öffentlichen Wiedergabe des Films oder des eingereichten Materials entstehen. Die Freistellung umfasst insbesondere Ansprüche auf Unterlassung, Schadensersatz, Abmahn- oder Lizenzkosten sowie die Kosten einer angemessenen Rechtsverteidigung (einschließlich Anwalts- und Gerichtskosten).
4. Haftung & Datenschutz
Die Übermittlung von Dateien erfolgt auf Risiko des/der Einreichenden. Das Festival haftet nur bei Vorsatz oder grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Im Übrigen ist die Haftung auf den vorhersehbaren, typischen Schaden begrenzt. Die im Rahmen der Einreichung übermittelten Daten werden ausschließlich zur Organisation und Durchführung des Festivals verarbeitet (Art. 6 Abs. 1 lit. b DSGVO). Weitere Informationen zum Datenschutz, insbesondere zu den Betroffenenrechten nach Art. 15 ff. DSGVO, sind in der Datenschutzerklärung des Festivals abrufbar. Mit der Einreichung erklärt sich der/die Einreichende damit einverstanden.
5. Schlussbestimmungen
Das Surf Film Festival Hamburg kann in nicht geregelten Fällen im Sinne des Festivals entscheiden. Mit der Einreichung gelten diese Teilnahmebedingungen als anerkannt. Es gilt deutsches Recht. Im Zweifel gilt die deutsche Originalfassung dieser Teilnahmebedingungen.
