General rules:
I hereby agree that I have secured all the necessary rights for the picture and sound of the film above. The display, screening, and production will not infringe on any contractual rights including but not limited to music, images, and content. I grant the Ontario International Film Festival (ONIFF) the right to use and license my film for promotional use without restriction in terms of location.
I confirm that I am the creator/author, owner/co-owner, distributor, or otherwise authorized representative of the film and am submitting with the intent for the film to be used in commercial settings in connection with its online screening. I am committing my film to be screened online with any entity the ONIFF has entered into a licensing agreement with and will not remove the film without the consent of the ONIFF.
I grant permission to feature, advertise, display, and compile my film, in whole or part. I also grant the ONIFF and its licensees, subject to the terms of the licensing agreement entered by ONIFF, the right to broadcast, or authorize other third parties the right to broadcast, portions of the film on local media outlets for promotional purposes.
I grant the ONIFF the right to use my name, image, and biographical materials of any individual associated with the film. I hereby protect, defend, and exclude the ONIFF, its directors, members, employees, consultants, and agents from and against all claims, complaints, cause of action, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with claims and/or third-party claims based upon the film.
I am submitting my film to the ONIFF for the purposes described above. This includes any breach of warranties or agreements stemming from proceedings of any kind against the ONIFF arising from or connected to transactional activity, (e.g., distribution, promotion, licensing, contemplated by this agreement). I understand and agree to these terms as evidenced by my signature below. This form supersedes all prior negotiations and agreements, oral or written. This agreement shall be governed in accordance with the provincial and federal copyright, trademark, and intellectual property law.
