LEGAL TERMS AND CONDITIONS

Upon submitting, the participant admits that he is legally authorized to authorize FotoFilm Tijuana Cultural Festival [heretofore referred to as FotoFilm], use and display of the submitted work with which they participate, without this constituting the transfer of copyright or exclusive use or author rights. The authorization granted by the participant is for FotoFilm to use, exhibit or project the submitted work, takes effect as long as the submitting participant has unique and exclusive rights for the promotion and cultural diffusion of the submitted work and that said authorization does not grant any rights for any commercial purpose, however extending said authorization to any digital platform linked to FotoFilm in the edition for which the participant is submitting the work.
The authorization that the participant grants to FotoFilm about his submitted work, extends to the use of image rights over stills, trailers, photographs, technical information and audiovisual material to be used in different formats or support materials such as printed editions and covering the use in electronic, optical, magnetic, social networks, data
messages or similar media and in general for any known medium or to be
known in the future; this use of rights is given without any geographical or
territorial limitation.

The participant is solely responsible for the brands, designs, names, registered trademarks, titles, models, music, essays or any other intellectual property right and / or content in general that may contain the work with which the participant submitss, thus safeguarding FotoFilm of any claim on rights whilst having the particular participant assumes the legal consequences and costs in case of breaking the corresponding laws.
The only consideration with which FotoFilm is committed by the use, exhibition or projection of the participant's work, is the recognition of the names of its filmmakers and those credited within the work.

FotoFilm will review and select the works submitted by participants, reserving the right to refuse works that it considers improper to the festival’s stated objectives and at any time FotoFilm may ask the participant for the documentation it deems appropriate or necessary about his work and to guarantee the terms and conditions stated within these terms and conditions.

FotoFilm reserves the right to contact student participants to solicit for proof of valid student status such as but not limited to: letter of enrollment, student identification or other means of verification. Likewise, FotoFilm reserves the right to contact participants to elicit further information regarding submissions, without these communications conferring upon these participants any additional commitments from festival organizers except when explicitly agreed to by both parties.

The participant accepts the terms and conditions when sending his work through the digital platform FilmFreeway. Failure to comply with these conditions may result in disqualification.

TÉRMINOS Y CONDICIONES LEGALES DE PARTICIPACIÓN

Al enviar su trabajo, el participante asume estar facultado legalmente para autorizar que FotoFilm Tijuana Festival Cultural [el cual será de aquí en adelante denominado simplemente como FotoFilm], utilice y exhiba la obra con la que participa, sin que constituya esto la transferencia de algún derecho patrimonial de autor o de uso exclusivo. La autorización que otorga el participante a FotoFilm para utilizar, exhibir o proyectar su obra, surte efecto siempre y cuando tenga por único y exclusivo propósito la promoción y difusión cultural y que no tenga ni vaya a tener ningún fin comercial, además extendiéndose dicha autorización a cualquier plataforma digital vinculada a FotoFilm relacionada a la edición para el cual el participante envía la obra.

La autorización que el participante otorga a FotoFilm sobre su obra, se extiende al uso de derechos de imagen sobre fotografías, ilustraciones u otro material audiovisual para ser utilizado en formato o soporte material para ediciones impresas, abarcando la utilización en medio electrónico, óptico, magnético, en redes, mensajes de datos o similares, así como en general para cualquier medio o soporte conocido o por conocer en el futuro; el uso de los derechos se dan sin limitación geográfica o territorial alguna.

El participante es el único responsable de las marcas, diseños, nombres, reservas, títulos, modelos, música, redacciones o cualquier otro derecho de propiedad intelectual y/o del contenido en general que pueda en su caso contener la obra con la que participa, sacando a paz y a salvo a FotoFilm de cualquier reclamo sobre el particular y asumiendo las consecuencias legales y económicas en caso de infringir las leyes correspondientes.
La única contraprestación con la que se compromete FotoFilm por la utilización, exhibición o proyección de la obra del participante, es la del reconocimiento de nombres de sus realizadores y de quienes tengan derecho sobre la misma.

FotoFilm revisará y seleccionará las obras de los participantes, reservándose el derecho de excluir las obras que considere impropias a los objetivos el festival. En cualquier momento FotoFilm podrá solicitar al participante la documentación que estime conveniente sobre su obra para garantizar el cumplimiento de los términos y condiciones aquí establecidos.

FotoFilm se reserva el derecho de contactar a los participantes que se declaren como estudiantes para solicitar documentos adicionales que avalen el estatus del participante como estudiante incluyendo y no limitados a: carta expedida por la institución donde el participante estudia, copia de identificación de estudiante vigente o algún otro medio de
verificación que los organizadores consideren pertinentes. Del mismo modo, FotoFilm se reserva el derecho de contactar a los participantes para obtener más información sobre sus presentaciones, sin que estas comunicaciones concedan a los participantes compromisos adicionales por parte del festival, excepto cuando haya sido mutuamente acordado por ambas partes.
El participante acepta los términos y condiciones al enviar su obra por medio de la plataforma digital FilmFreeway. El incumplimiento de estas condiciones puede dar lugar a ser descalificado.
