This is Hudson NY Shorts fifth year! This year's Best in Festival Winner will be awarded $500. HNYS will also facilitate a reading and production consultation for the Winning Screenplay! Filmmakers can expect to join a community when they enter the festival. The curator, Bonnie O'Neill, is a filmmaker and professor from San Francisco who has dedicated her life to the art of film. Her goal is not just to introduce great short films to amazing audiences, but to bring together filmmakers from creative pockets around the world.

Our festival will be cautiously hybrid in 2021. Coronavirus permitting, we will screen at the progressive venue, Time and Space Limited. TSL has been a creative fixture in Hudson since 1991. It is a cinephile's dream come true dedicated to the exploration of film. It's also a place where artists perform, display and expand into new areas. It's where filmmakers will make connections. It draws an interesting mix in the audience. Regardless of a live event, we will have an online component screening the entire festival for one week and holding an ancillary filmmaker Zoom Q & A. If we don't screen at TSL this year due to Covid limitations, the winning film will screen live the following year.

We have some fantastic advisors/judges including Ken Schretzmann who was the Editor of classic animation films such as The Lorax, Toy Story 3 and The Secret Life of Pets and Martin Huberty , Producer of Fried Green Tomatoes, Up Close and Personal, The War, Red Corner and Producer/Director of Deserter.

TERMS & CONDITIONS for FILM SUBMISSIONS

I/We wish to have our film/video/animation/music video/ entry(ies) hereby known as “ENTRY” included in the 5th Annual Hudson NY Shorts festival hereby known as “HNYS”. I/We grant HNYS, its festival director, Bonnie O'Neill and sponsors the right to show for promotional purposes on television, on the HNYS website (www.HudsonNYShorts.com), on sponsors websites, flyers, posters, press releases, etc. No more than two minutes of ENTRY or up to the length of the trailer submitted by the filmmakers. I/we understand that no materials included with this application will be returned.

I grant HNYS, its festival director, Bonnie O'Neill and its sponsors the full and free right and permission to use my ENTRY for broadcast, duplication, and advertising in association with HNYS, for the purpose of viewing on television, in theatres, on the internet, on the HNYS website, on sponsors’ websites, podcasting and/or for archival purposes and for any other valid, lawful purpose in any and all media now known or hereafter developed or devised, worldwide and in perpetuity.

I waive any right to inspect or approve the finished photograph, advertising copy, audio piece or printed matter that may be used or to the eventual promotional use that it may be applied.

I hereby release, discharge and agree to hold harmless HNYS, its officers, agencies, advisors employees and sponsors from and against any liability as a result of any use, distortion, blurring or alteration that may occur or be introduced in any use or broadcast of the material.

I grant HNYS permission to give a copy of the ENTRY to industry members if requested. Industry, includes but is not limited to network executives, agents, managers, casting directors, press and others that can aid in securing of future work and/or distribution for my ENTRY.

I waive any and all rights to compensation for any broadcast, duplication, and advertising of any ENTRY presented at the festival. All ownership of all ENTRY remains with the personnel who contributed to the ENTRY. I own all material submitted with application and that will be viewed at HNYS. I understand that HNYS, its producers and sponsors are relying on this release and accordingly, I hereby irrevocably waive any and all rights to seek or obtain any injunction or other equitable relief against HNYS, its officers, agencies, advisors, employees and sponsors.

I warrant that the use of the rights granted here and of any material supplied by me/us will not violate the rights of any third party. I agree to defend, indemnify and hold harmless HNYS, its officers, agencies, advisors, employees and sponsors from any claims by third parties alleging that our content or material infringes on any third party’s rights. This Release and Hold Harmless Agreement shall bind my assigns and any representative.

This contract is the entire agreement between the parties hereto, and replaces and supersedes any prior agreement or understanding, verbal or written, with respect to the subject matter hereof. No amendment, addendum, modification or waiver of this contract or any portion hereof shall be valid unless contained in a writing signed by both parties hereto.

In exchange for release, I receive the opportunity to have my ENTRY shown at HNYS and accept that there is no promise of additional payment, in any form for likeness, image, biography, recording, equipment, or for any other contribution by us on this production.

This contract shall be deemed to be entered into in County of San Francisco, California and shall be governed by and interpreted in accordance with the laws of the State of California applicable to agreements entered into and carried out entirely within California. I agree that any and all disputes or controversies arising under this contract or any of its terms shall be resolved under the auspices of the American Arbitration Association, under its Commercial Arbitration Rules, through its San Francisco office; provided, however that I agree that my remedies for any breach of this contract by the Hudson NY Shorts, its officers, agencies, employees and sponsors will be limited to damages to an action at law to recover and in no event will I be entitled to rescind or terminate this agreement or to seek injunctive or any other equitable relief.

I hereby certify that I am over eighteen years of age and competent to contract in my own name. If I am signing on behalf of an organization, I certify that I have authority to do so and that my signature binds the organization and its members to all elements of this contract.

I have read the foregoing release and authorization and agreement, before affixing my signature below, and warrant that I fully understand the contents thereof.

I am authorized to sign and give consent for everyone (including but not limited to performers, writers, directors, technical crew, distributors) who contributed to all ENTRY(IES) and all materials submitted with this application to the 4th Annual Hudson NY Shorts festival.

We reserve the right to refuse to consider any submission at our discretion.

TERMS and CONDITIONS (Screenplay Competition)

1. I/We wish to have our screenplay hereby known as "ENTRY" included in the 2nd Hudson NY Shorts: Screenplay Competition hereby known as “HNYS”. I/We grant HNYS, its festival director, Bonnie O'Neill and the festival’s sponsors the right to use for promotional purposes on television, on the HNYS website (www.HudsonNYShorts.com), on sponsors websites, flyers, posters, press releases, etc. my/our name(s), screenplay title and logline.

2. If more than one (1) party signs this agreement as submitter, then reference to “I”, “me”, “my” throughout this agreement shall apply to each party; jointly and separately.

3. My ENTRY has not been optioned, produced or purchased. If it does become optioned or produced or sold during the judging period then the ENTRY will be disqualified and the entry fee will be forfeited. It is my obligation to let the festival know that it has been optioned, sold or produced.

4. I understand creative revisions may be required prior should HNYS produce the film and therefore agree to the process as outlined by the HNYS staff. I also understand that if chosen as a finalist it is a requirement to sign a W-9 tax form to receive any prizes. I understand and accept without reservation that I am an independent contractor and that HNYS is not responsible for withholding any taxes or payments to any government agency, at any level, be it state, local or federal. Prizes are subject to change without notice. HNYS reserves the right to amend these rules and regulations at any time.

5. I grant the HNYS permission to give a copy of my ENTRY to industry members if requested. Industry, includes but is not limited to network executives, agents, managers, casting directors and others that can aid in securing future work or funding to make my ENTRY into a short film.

6. I/We own and am the only authors of the material submitted with application and are the only people that can lay claim to this work. I further claim that the submitted material is not adapted from work of any other author.

7. I have kept at least two copies of the screenplay and I understand that no materials included with this application will be returned.

8. I understand that HNYS may decide to increase or decrease the number of finalists at its sole discretion and reserves the right to grant less than or no awards, at its sole discretion, if a lesser number of, or no entries meet the submissions requirements and/or industry standards of excellence.

9. I understand that it is my sole responsibility to register Script with the U.S. Copyright Office or with the Writer’s Guild of America or the appropriate agency in my country.

10. I understand that HNYS, its producers and sponsors are relying on this release and accordingly, I hereby irrevocably waive any and all rights to seek or obtain any injunction or other equitable relief against HNYS, its officers, agencies, employees and sponsors.

11. I have read, understand, and agree to the rules and regulations stated for HNYS: Screenplay Competition and in exchange for release, I receive the opportunity to have my ENTRY read, evaluated and judged and produced by HNYS as part of its Screenplay Competition and accept that there is no promise of additional payment, in any form for likeness, image, biography, recording, equipment, or for any other contribution by us on this screenplay. If my ENTRY wins an award, that award will be divided among the writers, by the writers.

    I can't sing the praises of Hudson NY enough. I've had so many online festival experiences this year but this has been one of the best. It's so relaxed and personal it's one of the few that has come close to feeling like an in-person event. Bonnie and the team running this are such a warm, personable bunch that I can't wait to meet them in person and thank them for their support for my short film 'In Orbit'. This is a festival I'll come back to again and again. Well done!
