Building on our commitment to supporting filmmakers, ArcLight is tapping into Boston’s creative community to showcase local filmmaking talent and to share our excitement about the city. Local filmmakers are invited to submit original work that brings to life their vision of “24 Hours in Boston.”

Submissions will be received via the FilmFreeway platform now through Friday, December 31st at 11:59 PM EST. The films will be judged by a panel of experts and 5 finalists will screen their films at the ArcLight Boston Awards Event in early 2020. The winner of the contest will receive $2,500.00 cash and social media posts from ArcLight Cinemas.

Submissions will be received via the FilmFreeway platform between Friday, October 4, 2019 at 9:00 a.m. EST and Friday, December 31, 2019 at 11:59 p.m. EST. The films will be judged by a panel of experts and 5 finalists will screen their films at the ArcLight Boston Awards Event (date TBC, each finalist will be provided with 10 guest tickets). The winner of the contest will receive $2,500.00 cash and posts on ArcLight Cinemas social media.

Grand prize winner will be announced at ArcLight Boston opening event.

Five finalist filmmakers will receive a free one-year membership to ArcLight Cinemas, invitation to our awards screening and their film will be screened during our ArcLight Boston Awards Event. Grand prize winner will be announced at the Awards Event  and will receive $2,500.00 cash and recognition on ArcLight Cinemas social media.

All entrees must be submitted in a .mov or .mp4 file format and 1080p resolution.
Films will only be considered in this format and at minimum of 3 minutes and maximum of 6 minutes in length.

BY ENTERING THIS CONTEST, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. The ARCLIGHT 24 HOURS IN BOSTON Contest (the “Contest”) is sponsored by Pacific Theaters Exhibition Corp. d/b/a ArcLight Cinemas (“Sponsor” or "ArcLight"). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. The Contest is void where prohibited by law.

ELIGIBILITY
The Contest is open to legal residents of the 50 United States and the District of Columbia, who are at least 18 years old and the age of majority in their place of residence at the time of entry. Each eligible person who enters this Contest unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which are final and binding.

Employees, officers, directors, members, managers, partners, consultants, agents, and representatives of Sponsor, any administrator, co-sponsor, prize provider, or other entity – if any – participating in the design, marketing, operation, or fulfillment of this Contest and all of their respective parent, affiliate and subsidiary companies and advertising and promotional agencies (collectively, the “Contest Entities”), as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor has the right to verify the eligibility of each entrant.

CONTEST PERIOD The Contest begins at Friday, October 4, 2019 at 9:00am EST and ends at Tuesday, December 31, 2019 at 11:59pm EST (“Contest Period”). Entries must be received by the end of the Contest Period to be eligible.

HOW TO ENTER

To enter the Contest, eligible entrants should first create a short film a minimum of three (3) minutes and maximum of six (6) minutes in length based on the theme “24 hours in Boston” in either .mov or .mp4 format with 1080p resolution (each a “Submission”). Then, visit the Contest website available at https://filmfreeway.com/ArcLight24HoursinBoston (the “Contest Website”) and follow the links and instructions provided to complete and submit an entry form during the Contest Period in accordance with the instructions provided on the Contest Website and these Official Rules. Each entrant must complete the online entry form in full by providing his or her name, telephone number, e-mail address, and any other requested information and attaching (or providing a link to, if permitted) his or her Submission. Each Submission must be unique and may not be a duplicate of a prior Submission made by you or any other entrant. Your Submission and any other content you submit as part of your participation in this Contest is referred to collectively in these Official Rules as your “Entrant Content.” Additional requirements and limitations are set forth below. All Entrant Content must adhere to all requirements set forth in these Official Rules and on the Contest Website, including but not limited to length and format requriements.

GENERAL CONDITIONS OF ENTRY
Normal Internet access and usage charges imposed by your internet service provider may apply. Those who do not abide by these Official rules and the instructions of Sponsor or its representatives and provide all required information and content in their entry, may, in Sponsor's sole discretion, be disqualified and any associated entry by such person void. Any automated computer receipt (such as a “thanks for entering” message) does not constitute proof of actual receipt of entry by Sponsor. Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Sponsor is not responsible for lost, late, invalid, forged, mechanically reproduced, mutilated, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. Proof of submission of an entry will not be deemed proof of receipt. Entries may not be acknowledged and will not be returned. Entries in excess of any stated limit will be disqualified. Any individual who, as determined by Sponsor in its sole discretion, attempts to submit entries in excess of any stated limit (or encourages any third party to do so) through the use of multiple sets of or false contact information, multiple identities, or any other device or artifice intended to enter or encourage the entry of multiple or false entries will be disqualified and all associated entries void. In the event of a dispute as to any entry, the authorized account holder of the email address submitted at the time of entry (or will be disqualified if the authorized account holder does not meet the eligibility requirements. The “authorized account holder” is the natural person assigned the email account by the email service provider. Potential winners may be required to show proof of being the authorized account holder. Any dispute regarding the identity of an entrant that cannot be resolved to Sponsor’s satisfaction may result in all alleged entrants being disqualified. Entries or participation made on your behalf by another, made by you on behalf of any other individual, or made by any entity or group, and/or originating at or using any website or online service other than those described in the “How to Enter” section above, including, without limitation, through a commercial promotion subscription, notification, and/or entering service, will be declared invalid and disqualified for this Contest. As a condition of entering this Contest, each participant gives consent for Sponsor to obtain and deliver his or her name, address, and other information to third parties for the purpose of administering this Contest and complying with applicable laws, regulations and rules (including, without limitation, inclusion on a publicly disclosed winners list).

SUBMISSION REQUIREMENTS
PLEASE READ THE FOLLOWING REQUIREMENTS CAREFULLY. ENTRANT CONTENT THAT DOES NOT COMPLY WITH THESE REQUIREMENTS, AS WELL AS ALL OTHER REQUIREMENTS IN THESE OFFICIAL RULES, MAY BE DISQUALIFIED.

• If your Entrant Content depicts or mentions any identifiable person other than you, you agree that (a) such person is 18 years old or older and the age of majority in his or her state of residence and you have that person’s approval to include his or her name, likeness, image, voice, or other personal attributes in the Entrant Content and submit it in this Contest and can provide Sponsor proof of that approval in writing upon Sponsor’s request and within the timeframe requested or (b) such person is your own minor child or ward and you are capable of granting such approval on behalf of him or her. Your Entrant Content may not feature any individual who is a party to any agreement with any third party, or a member of any organization or union, that might interfere with your participation in this Contest or the use of the Entrant Content by Sponsor as provided herein. It is your responsibility to verify such possible relationships.
• All aspects of the Entrant Content must be originally created by and solely owned by you (or be in the public domain). No other person or entity may have rights to your Entrant Content. Except for materials in the public domain, all third-party content and content unoriginal to you is prohibited.
• Entrant Content must not create or imply any association between Sponsor and any individual or entity or his, her, or its products or services.
• Entrant Content must not contain any commercial or corporate advertising (including, without limitation, corporate logos, brand names, and slogans), recognizable branded products, or commercial artwork other than those of Sponsor.
• Entrant Content must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright (including moral rights), trademark, trade secret, or rights of privacy or publicity.
• Entrant Content must not include information or content that is false, fraudulent, deceptive, misleading, defamatory (including trade libelous), disparaging, unlawfully harassing, threatening, profane, obscene, pornographic, hateful, indecent, inappropriate, or injurious to any Released Party (defined below) or any other party. Entrant Content must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local laws, rules, or regulations.
• Entrant Content must be suitable for presentation in a public forum.
• Entrant Content must not suggest, depict, or describe any inappropriate, unlawful, or dangerous behavior or use of Sponsor’s or any other products or services.
• You agree that your participation in the Contest and agreement to these Official Rules and any Contest Entity’s display and use of the Entrant Content permitted under these Official Rules will not violate any agreement to which you are a signatory or party.
• To the fullest extent permitted by applicable law, you agree to indemnify the Released Parties against any and all claims for any use or reuse of your Entrant Content permitted under these Official Rules.

All Entrant Content must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor, in its sole and absolute discretion. Sponsor reserves the right, but will not be obligated, to review (or have its designee review) Entrant Content for compliance with these Official Rules. Sponsor reserves the right in its sole discretion to disqualify from the Contest any entrant whose Entrant Content refers, depicts, or in any way reflects negatively upon a Contest Entity, the Contest, or any other person or entity or does not comply with any provision of these Official Rules (including the above Submission Requirements) or other instructions of Sponsor, all as determined by Sponsor in its sole discretion.

LICENSE
By entering, except where prohibited by law, each entrant grants to the Contest Entities (and their agents, successors and assigns) the irrevocable, sublicensable, absolute and perpetual right and permission to use, edit, modify, copy, adapt, publish, display, perform, and exploit the Entrant Content in any and all media now existing or hereafter devices (including online) throughout the world, in any language, and in any manner for trade, advertising, promotional, commercial, or any other purposes, without further review, notice, approval, consideration, or compensation beyond the opportunity to win a prize in this Contest. Each entrant waives and releases the Released Parties from any and all claims that entrant may now or hereafter have in any jurisdiction based on "moral rights" or "droit moral" or unfair competition with respect to the Contest Entities’ exploitation of any Entrant Content without further notification or compensation to entrant of any kind, and agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Released Parties, each of their licensees, or any other person in connection with this Contest, on the grounds that any use of any Entrant Content or element thereof or derivative works therefrom in accordance with this license infringes or violates any of entrant’s rights (including MORAL RIGHTS) therein.

Each entrant hereby acknowledges and agrees that the relationship between the entrant and each of the Contest Entities is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to submit his/her entry for purposes of the Contest does not place any of the Contest Entities in a position that is any different from the position held by members of the general public with regard to elements of the Entrant Content, other than as set forth in these Official Rules. Each entrant understands and acknowledges that Sponsor has wide access to ideas, images, and other creative materials. Each entrant also acknowledges that many ideas or images may be competitive with, similar to, or identical to his/her Entrant Content and/or each other in idea, components, format, or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material that has or may come to Sponsor from other sources. Each entrant acknowledges and agrees that Sponsor does not now and will not have in the future any duty or liability (direct or indirect; vicarious, contributory, or otherwise) with respect to the infringement or protection of the entrant’s copyright in and to his/her Entrant Content or its constituent elements. Each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of a Contest Entity’s actual or alleged exploitation or use of any Entrant Content or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition, or other exploitation of any Contest Entity property or product, and entrant’s rights and remedies in any such event are strictly limited to the right to recover damages, if any, in an action at law (provided that nothing in these Official Rules will restrict a California resident’s right (if any) to seek public injunctive relief as permitted by applicable law and in accordance with the “Dispute Resolution and Arbitration” section below).

WINNER SELECTION & NOTIFICATION
First, each eligible entry received will be evaluated by a panel of judges selected by Sponsor in its sole discretion (“First Round Judges”), based on the following criteria in accordance with the percentage weight assigned to each:
30% Relevance to Theme film is made in Boston, focuses on “24 hours in Boston” theme in some way)
40% Creativity (filmmaker had an original take and explored Boston in a unique, thoughtful, beautifully way)
20% Skill (filmmaker exemplified skill in the quality of the film and different skills utilized (such as different camera angles and effects)
10% Presented within time restraints (minimum 3 minutes, maximum 6 minutes in length)

The 5 entries with the highest score from the First Round Judges will advance to the second round of judging (each a “Finalist”). In the event of a tie in the selection of any Finalist, the tie will be broken by naming as the Finalist the entry with the higher score on the “Creativity” criterion. If there is still a tie, the tie will be broken by naming as the Finalist the entry with the higher score on the “True to Theme” criterion.

Following the close of the First Judging Period, all eligible Finalists will be re-evaluated by a second panel of judges selected by Sponsor (“Second-Round Judges” and, collectively with the First-Round Judges, the “Judges”). The Second Round Judges will rescore each Finalist’s entry by applying the following criteria:

30% Relevance to Theme film is made in Boston, focuses on “24 hours in Boston” theme in some way)
40% Creativity (filmmaker had an original take and explored Boston in a unique, thoughtful, beautifully way)
20% Skill (filmmaker exemplified skill in the quality of the film and different skills utilized (such as different camera angles and effects)
10% Presented within time restraints (minimum 3 minutes, maximum 6 minutes in length)

In the event of a tie in the selection of the winner, the tie will be broken by naming as the winner the entry with the higher score on the “Creativity” criterion. If there is still a tie, the tie will be broken by naming as the winner the entry with the higher score on the “True to Theme” criterion.
Finalists are prohibited from offering inducement in connection with judging or obtaining votes by any fraudulent or inappropriate means, as determined by the Sponsor in its sole discretion, including, without limitation, by offering prizes or other incentives or inducements in exchange for votes or by manipulating browser settings or using multiple browsers/devices in order to submit votes in excess of the above-stated limit (or encouraging others to do any of the above). Use of these techniques, or any robot, spider, script, macro, or other automated or artificial system to vote, or acting in any manner with the intent or effect of impairing the integrity of the judging process, is prohibited. All judge votes that are (or are suspected to be) the product of such prohibited actions will, upon discovery by the Sponsor, be deemed null and void and may lead to the disqualification of the applicable entrant. Sponsor reserves the right to restrict or void votes from any device, account, IP address, or other identifiable source or for any entrant if any vote is determined or suspected to be fraudulent or otherwise in violation of these Official Rules, as determined by Sponsor in its sole discretion. Without limiting any other provision of these Official Rules, if the voting process is incapable of operating as planned for any reason (including, without limitation, Sponsor’s determination or suspicion of voting fraud or any other action that Sponsor determines has impaired or undermined the administration, security, fairness, or proper conduct of the voting process), Sponsor reserves the right to proceed with the second round of judging and to adjust the weights given to the other judging criteria accordingly.

The potential Finalists will be notified by phone or email on or about Friday, January 10, 2019. The potential Finalists will be required to respond to Sponsor as instructed within forty-eight (48) hours of the date of notification or other time frame as specified by Sponsor in the notification.

Potential prize winner(s) may, in Sponsor’s sole discretion, be required to complete, sign, have notarized (if applicable) and return an Affidavit of Eligibility and Liability/Publicity Release (unless prohibited by law) and tax documents, if applicable, or similar prize-acceptance documents (collectively, “Prize Winner Documents”) within the time frame specified and in the form provided by Sponsor, without revision, or prize may be forfeited. The Prize Winner Documents may require potential winners to provide a copy of their government-issued ID or number therefrom. The Prize Winner Documents, if applicable, must be received by Sponsor within five (5) days of Sponsor sending the documents to the potential winner or other time frame as stated in the Prize Winner Documents, or prize may be forfeited and an alternate winner may be selected. The prize claim and Prize Winner Documents are subject to verification by Sponsor. The prize(s), if legitimately claimed, will be awarded. Sponsor will not be obligated to pursue more than three (3) alternate winners (time permitting) for any prize for any reason, in which case that prize may go unawarded.

If a potential winner cannot be contacted or does not timely respond as instructed, or if a prize, prize notification, or other Contest-related communication is returned as undeliverable, that potential winner may be disqualified. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

The Total ARV of all prizes available in this Contest is $2,575.00

All prize details not specifically stated in these Official Rules (including, without limitation and where applicable, the color, size, make, model, type, and/or features of a prize) will be determined by Sponsor in its sole discretion. Sponsor makes no warranties, representations or guarantees relative to any prize, and disclaims all liability for the provision, use, quality or nature of any third-party product or service provided to a prize winner. Each prize winner is responsible for all taxes resulting from acceptance and use of the prize, and all costs and expenses not specified as part of the prize. Except for the prize values, no prize winner will receive any additional monetary compensation or acknowledgement for participation in the Contest, any advertisement or other material.

By entering this Contest and accepting a prize, each winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest- or prize-related activity, including, without limitation, attending the prize event. Winner understands and agrees that Sponsor and prize providers have the right, in each of their sole discretion, to disqualify and remove winner or his/her guest(s) from any activity at any time if their behavior is at any point uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor or otherwise violates the policies of the prize provider, and in such a case, such winner will be solely responsible for any and all related expenses. Guest(s) of winner must be the age of majority in their jurisdiction of residence.

ADDITIONAL LIMITATIONS & DISCLAIMERS
Prizes are non-transferable except by Sponsor and must be accepted as awarded. Prizes cannot be used in conjunction with any other promotion or offer. No substitution or cash equivalent of a prize is permitted; however, Sponsor reserves the right to substitute any prize with another of equal or greater value. No winner is entitled to the difference between the approximate retail value and the actual value of any prize. Sponsor is not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in the printing or posting of the offer or Official Rules, the selection and announcement of any winner, or the distribution of the prize. Any attempt to damage the content or operation of the Contest is unlawful and subject to legal action by Sponsor or its agents. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate or suspend this Contest if the Contest cannot be operated as planned or should virus, bugs or other causes beyond Sponsor’s control corrupt or impair the administration, security or proper play of this Contest. In such event, Sponsor reserves the right to void the entries at issue or cancel the Contest and select a winner from the eligible, non-suspect entries received up to the time of cancellation that have not been compromised (if any) or as otherwise deemed fair and appropriate by Sponsor in its sole discretion. Sponsor will not replace any lost or stolen prize items.

Sponsor reserves the right, in its sole discretion, to void participation by any participant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest. Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. Participants waive any right to claim ambiguity in the Contest structure or these Official Rules. If Sponsor determines, at any time and in its sole discretion, that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If any person supplies false information, obtains an entry by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law.

Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the participant, or by human error: entries that are submitted by illegitimate means (including, without limitation, any automated computer program); lost, late, incomplete, misdirected, stolen, garbled, unintelligible, or illegible entries, email, mail, or Contest-related correspondence or materials or any postage-due mail; address changes of entrants or entries not received in accordance with these Official Rules; viruses or technical, mechanical, hardware, or software malfunctions of any kind; failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic or other communications; errors, typos or misprints in these Official Rules, in any Contest-related advertisements, or other materials; failures of any of the equipment or programming associated with or utilized in the Contest; failed, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or failures of any network or wireless or Internet service provider; unauthorized human and/or mechanical intervention in any part of the Contest; technical or human error which may occur in the administration of the Contest or the processing of entries; or any injury or damages to the entrant's or any other person's computer related to or resulting from accessing or downloading any Contest materials. Without limiting any other provision in these Official Rules, Released Parties are not responsible or liable to any participant or winner (or any person claiming through such participant or winner) for failure to supply a prize or any part thereof in the event that any of the Contest activities or Released Parties’ operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ENTRANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY THE CONTEST ENTITIES AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”) FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES) WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), CONTRACT, WARRANTY, STRICT LIABILITY, RELIANCE OR UNDER ANY OTHER THEORY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT'S PARTICIPATION IN THE CONTEST OR THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON, AND WHETHER OR NOT SPONSOR OR ANY OTHER RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO RELEASED PARTY MAKES ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF ANY PRIZE.

ENTRANT UNDERSTANDS AND AGREES THAT HIS/HER PARTICIPATION IN THIS CONTEST AND USE OF ALL ELEMENTS OF THIS CONTEST IS AT HIS/HER OWN DISCRETION AND RISK. ALL ELEMENTS OF THIS CONTEST ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. ENTRANT UNDERSTANDS THAT THE RELEASED PARTIES MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE RELIABILITY, TIMELINESS, AVAILABILITY AND/OR PERFORMANCE OF ANY ELEMENT OF THIS CONTEST. THE RELEASED PARTIES DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.

ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

DISPUTE RESOLUTION AND ARBITRATION
You and Sponsor agree that all disputes between you and Sponsor with regard to the Contest and these Official Rules will be resolved by binding, individual arbitration under the American Arbitration Association's ("AAA") rules for arbitration of consumer-related disputes or under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event both AAA and JAMS are unwilling or unable to set a hearing date within forty-five (45) days of the filing of a “Demand for Arbitration,” then either party can elect to have the arbitration administered by another mutually agreeable arbitration administration service who will hear the case. YOU HEREBY EXPRESSLY WAIVE A TRIAL BY JURY. CLASS ACTION WAIVER: Neither you nor Sponsor will participate in a class action or class-wide arbitration for any claims covered by these Official Rules. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award are final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. Notwithstanding the above, Sponsor will be entitled to seek injunctive or equitable relief in the state and federal courts in Los Angeles County, California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Desktop, online, written or telephone arbitration can be used for claims. If an in-person hearing is requested by you, required by the arbitrator or required by the rules of the arbitration administration hearing the claims, then arbitration will take place in Los Angeles County, California, however if the dispute is being administered (i) by the AAA, the location will be in a reasonably convenient location to both parties with due consideration of their ability to travel, or (ii) by JAMS, in your hometown (if required by JAMS arbitration procedures). Payment of all filing, administration and arbitrator fees will be governed by the rules of the arbitration administration hearing the claims. You alone will be responsible for your attorneys’ fees and will pay for all of your own travel costs if you initiate arbitration and you request an in-person hearing. Judgment on the award rendered by the arbitrators may be entered in any court having competent jurisdiction.

THE SUBSTANTIVE LAWS (AS DISTINGUISHED FROM THE CHOICE OF LAW RULES) OF THE STATE OF CALIFORNIA WILL GOVERN THE VALIDITY AND INTERPRETATION OF THESE OFFICIAL RULES AND ALL CAUSES OF ACTION (WHETHER SOUNDING IN CONTRACT, TORT, OR OTHERWISE) ARISING OUT OF OR RELATING TO THIS CONTEST AND THESE OFFICIAL RULES. THESE OFFICIAL RULES WILL SPECIFICALLY NOT BE GOVERNED BY THE UNITED NATIONS CONVENTIONS ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS, IF OTHERWISE APPLICABLE.

You agree that any action at law or in equity relating to the arbitration provision of these Official Rules will be filed only in the state or federal courts located in Los Angeles County, California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

PUBLICITY AND USE OF INFORMATION
By participating (except where prohibited by law), each entrant grants the Contest Entities permission to use his/her name, likeness, voice, or other personal attributes, as well as any biographical information or comments, for advertising, trade, or publicity purposes – in any medium anywhere worldwide – without limitation on time, without further obligation or payment of additional consideration, and without notice, review, or approval. Each entrant releases the Released Parties from any liability related to the exercise of rights granted under this section and understands that nothing herein obligates any Contest Entity to make use of such rights. Personal information collected from entrants during the Contest is subject to Sponsor’s privacy statement available at https://www.arclightcinemas.com/learn-more/privacy-policy/ or such other privacy statements as appear on the applicable website and, except as otherwise provided in these Official Rules, will be treated in accordance with the terms of that statement. Sponsor may engage certain third-party companies to perform services in connection with the administration of this Contest and information provided by entrants may be disclosed to and/or collected and used by those third parties for purposes of administration of the Contest and the fulfillment and verification of prize awards.

The winners name(s) may be requested by sending a self-addressed stamped envelope to: ArcLight, Attn: 24 Hours in Boston, Contest Winner's List, 120 N. Robertson Blvd., Los Angeles, CA 90048. Requests must be received within six (6) months of the conclusion of the Contest Period. One request per outer envelope.
